As noted boarding is a service is is governed by the service contract. When the boarder is about to “sign on the dotted line” they should first read the WHOLE contract and ask questions. If a BO won’t answer reasonable questions then maybe the boarder should look to their “hole card” and rethink the issue.
Even with a contractual time limit if a boarder commits a criminal act on the premises the BO would be wise to get them ASAP (maybe be nice enough to let them post bond, first) but move them down the road.
Or course the “Fix” is to give a reasonable time in the Contract for someone is asked to leave but put “escape language” in to cover exigencies (such as bad behavior towards humans or horses, drunkeness, property damage, etc.).

P.S. If the BO gives the boarder a notice to leave and they have prepaid on the month, and maybe have a security deposit, then that money must be refunded ASAP. And if the boarder said they wanted the refund BEFORE they left a BO would be hard pressed to say “no.”
This right here. Seeing BOs harm the animals as an act of spite to the owners really irks me. If that’s how they feel/act when they are upset, they shouldn’t be in the biz.
Always good to have a plan B, and if the BO does appear to be crazypants…might want to be proactive. All horse people are crazy but some take it to an extreme level.
Besides physical violence, there is not a situation i can imagine that would warrant a 2 day notice to evac. that’s messed up. I would be leaving asap if i saw that done to someone. You could very well be next.
Thank you everyone, it’s my first experience with this kind of thing. I have admit, I’m scared because I’m in a new state and have limited resources. This BO is apparently known for being aggressive enough to try to black list boarders who give notice calling ofther stables telling them not to take the boarders for false reasons. I’m sorry to bother everyone, it just begins to feel isolating, my horse comes first, always! The stress is killing me
Yeah, I am so over giving my money to crazy people. I’m also done giving money to lazy people when it comes to horse keeping I moved to a new stable, and have no regrets. I did pay 1 month of double board, but it was so worth it to be out early rather than stay another month.
If I recall correctly, there was a thread a few years ago that talked about bailments. My understanding is that when you board your horse, the BO assumes an obligation to properly care for him while he is in their possession. Does telling you to get out tomorrow relieve the BO of responsibility to continue take care of the horse as long as they are on the property?
It is always a good idea to understand your contract and your rights, but when things go south, sometimes the best (and safest) thing to do is just get out.
Put together a list of 3-4 local barns you can move to in a moment’s notice. My list is a combination of barns I’ve boarded at before and barns friends board at. I also have a list of people who know people that I could reach out to. Sometimes, these barns are not places I would want to stay long, due to distance or amenities or whatever, but they are all safe and will work for a few weeks or months while I work into getting into a long term solution. Figure out how you will move your stuff. If it can’t fit in your vehicle, do you have friend(s) with trucks who could help you move? Keep a list of those as well (one could be out of town when you need to move, etc). Otherwise, UHaul has trucks.
Figure out where to store your stuff. If you don’t have room at home, can a friend take it temporarily? Or will you need a storage unit?
Put together a trailerling list. Do any of the barns on your emergency list offer trailering services? Do you have friends who will trailer in an emergency? If you have a truck, are there local trailer rental places? Who are the local haulers? As with barns, get a list of 3-4 options you can try.
Depending on your situation and what you can do yourself, where friends might be able to help, and where you will have to pay out money, check that your emergency fund can absorb the cost of a sudden move. If not, address that ASAP.
Once you have a plan for where you will go and how you will get there, the idea of an emergency move is much less daunting. If your current barn situation really is going downhill, you may want to start looking around for a new permanent solution now and move before it is an emergency. But if the situation is more complicated and you think the issue was isolated to the one other boarder & it’s still a good situation for you… nothing wrong with contingency planning on your part. FWIW, I have this mental list no matter how awesome my current barn is. Tragedies happen (barn owners get sick, barns burn down, natural disasters, etc) that can trigger a fast move even in ideal situations.
A bailment is a contractual event. So we have to know what the contract says.
You’d have to go back to the law of the state involved to see what rights, if any, a boarder might have if none are stated in the contract. An easy “sell” to most judges would be an argument that if the boarder must give a 30 notice to leave that a barn owner should, in equity, have a similar obligation. Or if not a full 30 days at least a “reasonable time” which would be more than 72 hours.
Still, under the circumstances the OP should pull up stakes ASAP and if she want’s to play “guts ball” tell the BO to “cop a walk” on the issue of the 30 day notice. If she just wants to be shut of the matter pay whatever board is due on the day of leaving and move on down the road. If the BO “bad mouths” her and damages her reputation then hire “junk yard dog” lawyer and teach the BO a lesson in the law of defamation of character.
The BO hasn’t done anything directly to me, however, she went after a client of the girl she had removed, attacking her character etc. all false accusations etc. I gave notice, I will be moving before the 30 days are up because I found out this is not the first time the BO has done this. I just dont understand how she gets away with all the downright Illegal IRS tax evasion, illegal additions to the property etc etc etc, but I dont want part in it anymore! I am afraid shes going to black list me, even though i have heard some people know of her and disregard her, that doesn’t mean everyone does
