Real estate lien is not your only collection option. Bank account and vehicle levy and sheriffs sale are all possible actions. Be sure to name her AND her company name in the suit. You may have to pay 2x the filing fees. Hopefully you paid with a credit card and can get reimbursed.

So your order has been on hold since July 
 meaning the saddle maker has been aware of her shenanigans for several months, at least.

Thinking it’s time for the saddle maker to issue a public announcement that she is no longer in good standing with him, and he’s not taking any of her orders. It would be great if he has a website and will put it on the landing page.

That’s what would help stop her from taking more money from people. Otherwise how can they know things have changed?

Do get the word out on all social media

If you paid by credit card contact your credit card company/bank and file a dispute stating that your never received your merchandise. That will cost you nothing and the credit card company is required to research your dispute and if the facts support your claim, refund your money.

She had her saddle on consignment for two years ?!?!

Oh my lord. That email from ASF that is on the BBB site is almost too much. It’s written in this hyperformal business-speak to make it seem like it’s no big deal that they “accidentally” sold the consigned saddle and then sent a completely different saddle to the consignee, hoping that she would go away.

And then ASF offers to send the complainant the money for the sold saddle LESS THE COMMISSION despite the length of time and the amount of trouble and general ill-will and distrust caused by ASF’s practices.

Really? This person is supposed to be a professional?

This situation has all of the hallmarks of the saddle fitter having a cash flow problem/being in financial distress. I would lawyer up immediately and ask your lawyer to see if she has filed for bankruptcy. If so, there are a lot of things you may need to do immediately that will require the assistance of a lawyer. Even if she isn’t in bankruptcy, you should be taking legal steps right now to recoup your loss. Unfortunately, the legal fees in a situation like this frequently exceed the amount of your existing loss. So it can become a cost/benefit analysis issue.

If you paid by check, go to your bank find an officer and start a Late Returned Check process to back the check through the system to return the money to your account

So, after a call to the the credit card company who said I’d have a refund in 3 days (bless discover card) and the police (who called the saddler, who then promptly called me back, finally!), the situation may finally be underhand. She is a very good saddle fitter and seems knows a lot which is why I chose her originally.

She offered to come out to the barn and have another look at my horse, remeasure, and have another saddle ordered from a different saddle maker. Of which I wouldn’t pay her a cent until my finished saddle is in my grubby-little-snot-hands. This is because I’m told it’s really a problem with Adam.

I accepted this offer. I kinda figured it wouldn’t hurt.

Am I crazy, or just assume the best of people, when will my bad life choices stop!

As long as you’re happy, that’s all that matters. Just don’t give her one red cent until you have physical possession of the saddle.

OP, if she were a serious businessperson she would have kept you informed of her supposed problems with Adam all along. At this point, the odds are that she is feeding you another line to get you to drop the complaints with the police and credit card company.

At this point, I wouldn’t believe her claim that she’ll make good on your money unless she gives you some means of ensuring you get your $2000 back no matter what happens or what she does. and a fixed date to receive your new saddle, come what may, backed up in writing. With proof that she actually paid the saddler.

Really, you’d be better off asking for a refund and starting from scratch with someone else.

The way I read it, the OP is getting the money back via her Discover, and the saddle fitter is going to get a saddle from another maker. The OP doesn’t pay out any more $$ until she’s got that new saddle in hand.

Super shady behavior, IMO, but if you’re happy, OP, that’s all that really matters.

(But if you still don’t have a saddle in six months, don’t say we didn’t tell you ;))

You had to jump through hoops to get your money back, outed her on a bulletin board for her shady business practices, and CALLED THE POLICE on her, and you’re using her for another saddle? I’m just
wow.

I wouldn’t continue doing business with her.

I agree that I wouldn’t want her to be working on another saddle for me. We hear so often of people having custom saddles made that arrive and do not fit properly (even from very reputable companies) and the stress they have to go through to get the situation made right, I couldn’t imagine having to go through that with someone like this who needed the police involved just to get back to you.

You can start from scratch with her, if you feel so inclined.

Hers is definitely a peculiar business approach though. I know for sure, she has fulfilled some orders since July, just cannot figure out, how the lucky recipients get picked. Perhaps, something along the lines of satisfied barn owners, who would then recommend her to others
?

If Adam Ellis is the problem, then why was she still offering it about a month or two ago?

OP, I thank you for opening this thread, though I am worried sick over my order and money possibly lost. What a great start for holidays! Europe is, of course, shut down for two weeks, so all I can do for now is to sit and chew on my nails until, well, next year! :sadsmile:
