Although I’m surprised that Kocher’s attorney is posting here, I’m not surprised at the lack of paragraphs.
Most busy attorneys have secretaries to transcribe their briefs and their correspondence and are not in the habit of writing properly (no offense meant to the attorneys here on COTH that do write properly.)
I do wonder if Kocher is being billed for his attorney’s time as he defends his reputation (not Kocher’s) on social media. That’s none of my business of course…
I have to say, after reading the entire FEI response, including that of Mr. Kocher, I would have guessed that he had no legal representation whatsoever.
Well, he did defend himself here by talking about what a dirt bag the other guy was. As if that makes it impossible for the dirt bag to be a victim. Reminds me of defense attorneys claiming a woman couldn’t have been raped if she was a prostitute.
He also claims I am someone I am not, while he chastises “Sarah” for never bothering to find out the results of his case. So much to unpack here.
I think you misread my post. He didn’t defend Kocher in his post and Kocher seemed to have no defense to present to the FEI.
It is weird, I’ll grant you that, but so is digging up dirt about Kocher’s attorney. The attorney is just doing his job.
I just feel it’s not cool to dig up an attorney’s mugshot especially without including the fact that they were never charged for that crime. Sarah or not, doesn’t matter (except for the added weirdness factor.)
It wasn’t hard to ‘dig up’. The only name I ever heard associated with Farmer/Glefke was the woman. I googled him. There it was. And it didn’t matter to me if he was an attorney or not.

I don’t even know of partner-level, top-10 global firm lawyers who routinely have PAs transcribe legal briefs/correspondence let alone social media posts. Give me a break. What PA would be making posts on some backwater specialty hobby bulletin board for her/his “busy” attorney boss?
As a lawyer, I found his post completely cringe worthy. Forget the lack of paragraphs (we call that a lack of white space in legal drafting), the rando capitalisation of non-defined terms was embarrassing and the content came off as desperate and defensive. Also, that he felt the need to come on a bulletin board like this with any response whatsoever tells us all we need to know. It is way too “hurt feelz” for anyone to consider him to be in possession of any degree of professionalism. The fact that he got the poster’s identity complete wrong while holding forth as though he had her IDed wrt several aliases is a stunning display of incompetence.
He appears to have no professional pride as well as no drafting skills and that’s just embarrassing as all get out.
I don’t know any top 10 Global Firm lawyers, only a few friends in private practice eta (I stand corrected) it’s a FIRM (a partnership) and they have secretaries who transcribe much of their professional correspondence. They aren’t corporate attorneys in huge law firms. My experience with attorneys may well differ from the norm so I should not have written “most attorneys”…
Of course I can’t imagine either of them ranting on a forum, so there is that.
I would assume by his 1 huge paragraph explanation that he is unused to writing. I could well be wrong, however that wasn’t really the point.
It was a weird post for sure, him thinking “Sarah” is out to get him, however my point being it also seems a little weird to post a mug shot of someone’s lawyer without following up that charges were never filed against him.
After reading the “reasoned decisions” it was evident to me that he had a lousy (or disinterested) attorney.
Not surprised that he (the attorney) came here and went on a weird rant, only because Rudy Giuliani has negated any shape or form of surprise I will ever have again regarding the behavior of any member of the Bar in the U.S. (and Giuliani has only had his license suspended.)

I also agree with @FitzE on the dictation - I’ve practiced for 15 years, in the US and the UK, and have never known an attorney to actually dictate to a secretary.
You do realize that when I said “transcribe” I did not mean take dictation, in person, as in having a secretary take shorthand?. Apparently some attorneys do what some MD’s do and speak into recorders, after which their words are transcribed by their assistants, then reviewed by the principle, approved (or not) and then mailed or emailed.
My attorney friend is not a big time corporate attorney and spends most of his days in court. He would not have enough hours in the day to do his job well if he didn’t have that help.
Because your work experiences are different do not make his any less valid.
FWIW, watching my mother (atty) type with just her index fingers sends me up the wall, so I have had her dictate to me while I type when it’s not a confidential thing (lease agreements on industrial properties etc.).
I don’t think their office has someone paid to do this task, but it’s also far from a top-tier joint.
I agree that it’s weirdly defensive to come on COTH and explain the circumstances of a tangental at best arrest. But people have felt compelled to come on and respond to less. Someone who is unfamiliar with these boards and the posting format and is a little emotional/wound up might respond in “wall of text” style. That’s not uncommon for “first posts” by new posters.
I don’t derive much of anything from the style of the response and I think the actual defense of AK, at least as reflected in the FEI report, speaks for itself. After asking for extra time and producing little to no additional evidence, the proffered defense is that AK clicker trains his horses even though one has ever seen him do it and he’s never mentioned in in the press. And he was so concerned with dropping and losing a $3 clicker you can buy at Petsmart that he rigged a secret string to it and covertly wore that under his clothes. And everyone who saw him shocking horses or who he discussed training with is a liar and out to get him or doesn’t know what they’re talking about. His horses leap out of their skin and act frantic when he rides them, but that’s just classic conditioning done with a clicker the way you’d train a dog to shake hands or sit pretty for a treat.
I think there’s a decent chance he gets disbarred. Attorney have been disbarred for less.
A disciplinary hearing is different than a court sanctioning an attorney as part of underlying litigation. This type of disciplinary hearing is where the more serious punishment is likely to be metered out.
