That jury question leads me to believe the jury could lean towards NGDI since defense expert saw him about 12 months sooner than Mr Pistachio

What this process of them asking about the psych’s meeting with Barisone shows is that IF the jury asked ‘what were LK’s movements from seeing the car approaching to the ambulance’ the courtroom would have to lay out every single discrepency…!

C’mon jury… Do it. Ask.

So, its clearly important for the Pros/Defense to get an actual answer to the question asked. Dates. Why didn’t these experts give specific dates??? Seems obvious that this would be important facts to offer.

Like EDs info about his notes about the call he had with LK and RG on 8/7. Write the date and time of the call, and of when you wrote the notes.

I would hope that there isn’t an automatic lifetime SafeSport ban simply for being charged of a felony then fully acquitted, at least not without a separate investigation. MB’s situation might be a bit of a gray area given the separate complaints directly to them, but there have been way too many instances in the past of innocent people being accused of crimes to justify automatically banning for life just based on accusations they weren’t found guilty of.

If they didn’t at least provide him the opportunity to appeal and go through an arbitration process… then yikes.

And again… for the record… I’m a supporter of SafeSport. And have pushed back against people who have repeatedly made arguments concerning a lack of due process.

But the whole appeal process is pretty essential. And it doesn’t seem like MB has had the opportunity to appeal his ban yet, what with the whole criminal proceeding hanging out there.

I believe the experts did give specific dates, which is why they can find the information in the testimony and relay the dates to the jury.

I’m wondering if there’s a way to come up with some sort of hybrid between the court camera and the blink camera, so it sends you a notification when there’s any activity other than the state seal on the wall. Lol. :thinking:

Meh, seems like the court is feeling burdened by trying to dig it up.

Seems like it would be something to clarify right at the opening of interviewing the witness, not buried among questions and cross examination.

I believe all safe sport suspensions like this are pending the resolution of the criminal charges. So they would not hear an appeal until after the end of the criminal case.

I think they all gave dates except the psychiatrist. He said it was about a month after and it seems he gave the month and general date but not a specific.
