IMHO it’s privileged in regard to the Landlord Tenant matter.

As far as the secret recording I’d bet a Buick this guy won’t ever represent them again. Lawyers do not like being secretly recorded.

But not if the recordings were a crime, that waives the privilege, correct?

I’m not sure that’s what’s going on. This may be about relevance, where the relevance of the conversation and the recordings is to be proven at a later date, but discussed now as this witness has information pertinent to it.

Or do you mean when he first met them and signed on, not for the trial today?

I’m guessing that a crime done by unrepresented RG does not waive privilege for LK which tells me that whole thing may have been planned by someone knowledgeable in law.

the recordings themselves may not be legal, but if the attorney was not aware of them, then they are not discussing the commission of a crime and therefore privilege isn’t broken.

Privilege is destroyed if the client discusses with the attorney the intention or means of committing a crime.

ETA: I’m referring to the attorney not knowing they’re recording HIM. If they discussed recording others and that was a crime in progress, that is not privileged communication.

From what we were told over and over again on these forums by LK about what would come out at the trial and how bad it would be for MB, it certainly has gone the other way, has it not? She and RG have come across even worse than most of us could of imagined.

Well, he claims RG wasn’t his client and couldn’t remember him there…but RG has already testified to his being there and making a statement and there is a recording of it. So….

I can tell you they don’t know each other well enough for David to know how bonkers Lk is. That relationship is in the toilet now. It will get around and Lk may have terrible getting representation from top firms…

Whilst there’s a bit of a lull in proceedings (again), here’s good old Rosie. I guess it makes sense to call her a sleepy Dachshund cross on the stand and cast doubt on how tall she might be, but call her a jumping Doberman Shepherd cross on your Insta back in 2017 when she’s leapt onto your outdoor table. Those legs definitely aren’t Dachshund length …

It’s certainly testing some legal acumen not usually seen in something like this…

I feel for the jury trying to make sense of all of it when a person’s life is on the line.
