Der Dau DON'T

All I wanted was a fabulous pair of Dream Boots. My experience has been nothing short of a nightmare.

Over the past 20+ years I have attended Dressage at Devon annually as a spectator, box-holder and exhibitor. Every one of those years, as we enter the main gates of DaD, the vendor Der Dau Boots has been front and center, adjacent to the Dixon Oval. A position of prestige and stature.

This year, I finally decided to take the plunge and make that big expensive purchase – a pair of Custom Der Dau Boots. Joe Der and I discussed what I wanted based on the displays in his booth. He took notes, measured me and the order was placed and paid for.

Firstly, October 28 I received a shipment of Boots. Upon opening the box, they were not what I ordered. Absolutely wrong boots with another customer’s name inside. Mistakes happen. I contacted Der Dau twice before receiving the return Federal Express Shipping Label so that I could return the boots to them. At that point in time, I was told they had no idea where “my” boots were.

I never received any other contact from Der Dau until the date the Second pair of boots arrived, on November 8. Upon opening the box, while the boots were approximately what I ordered – the right color, there were flagrant deficiencies in the Black Exotic Leather Upgrades to the top cuffs and spine – the design and leather were Wrong. Upon trying them on, the boots absolutely did not fit. The zippers stopped half-way up the shafts and there were 2” and 3” gaps at the tops. If I was trying off the shelf boots at a retail store, the salesperson would immediately see that they did not fit.

I immediately contacted Der Dau and spoke with Kathleen. Her response was disinterested and apathetic. She told me all new leather boots are stiff and take time to stretch out. I explained that the zipper didn’t make it more than halfway up the shaft with a 3” gap at the top. I explained that the leather upgrades were incorrect. She was non-responsive. I asked for their email address and sent photos. They Still did NOT respond. I called again the following day, again, I received another lackluster response from Kathleen. I was told to put scotch tape where the zippers stopped, send the boots back and they would let the leather out. But Joe TOOK CUSTOM MEASUREMENTS!!! Now they were going to rely on scotch tape to make corrections, and “letting out the leather” was not going to correct the fit. I asked about the incorrect design and leathers used and she did not respond. The boots needed New shafts. Again when I mentioned that, there was no response.

In addition, at the point of sale Joe had offered a Show Special, a $300 Boot Tree/Boot Bag/Boot Care Kit for $150. What I received was a pair of plastic boot trees that retail on Amazon for $29.94. I asked about that, she made a vague response that they would send it out, which they never did. But what about the boots?

I agreed to put the tape on the boots as she instructed and asked her to send a return shipping label. The label was not sent. I contacted her twice more for the Shipping Label and still it was never sent. At that point I told them I wanted a total refund, I was told they have a No Refund Policy.

On Monday November 13 I attempted to contact them via Social Media and was blocked. At that point I knew that they had No Intention of making Any effort to correctly fill the order. The Whole Situation reeks of a fraudulent transaction.
I Finally Shipped the boots, and all accompanying items back to Der Dau on Tuesday November 14, and I have Fed Ex proof of delivery from Weds. November 15. I have not heard anything from Der Dau. .
When a customer makes a purchase, especially a CUSTOM ORDER there is an assumption of a WARRANTY OF MERCHANTABILITY. That the item purchased will actually be Useable/Wearable. This item was not, the accompanying photos prove it and the Merchant has NEVER ACKNOWLEDGED THE ISSUE. There was a lackluster offer to make a partial correction and to date they have never followed through. They have Never reached out to me, I was chasing them for a resolution to this issue.

I have been disputing the charges via my credit card company. Their response to the cc company was that they produced the boots, shipped them to me and they arrived, and Oh, by the way No Refunds.

YESTERDAY, Dec 21, 2023, Joseph Der called me. From a blocked phone number. My cell read “Unknown - No Caller ID” I almost didn’t answer it as I thought it was a scam call. Basically it was. What legitimate business makes a call from a blocked number? After 6 weeks from my receipt of the incomplete/incorrect product, and 5 weeks after the product was returned to them, he only reached out yesterday because of the Credit Card Company’s Second charge reversal. He called to bully and intimidate me with threats of legal action. Again, not the actions of a legitimate business. He stated he not have received or seen any of the emails I sent. However, during the conversation, he referenced photos that were only sent via those emails. He made vague claims that the boots have been under repair all this time but could not give me a status or timeframe.

It’s Too Little, Too Late. When a Customer makes a purchase, in this case a very expensive Custom Order there is an assumption of a WARRANTY OF MERCHANTABILITY. That the item purchased will be useable/wearable. This item was not and Der Dau Never acknowledged the issue, Never reached out, Never acted in Good Faith. Six weeks without communication from Der Dau. This transaction and interaction with the company lacks integrity. After six weeks I have moved on and am no longer interested in this transaction. My only intent is to get my money back. When I shared this with him, he only repeated his threats of legal action. I will Not be bullied or harassed into completing a fraudulent transaction. STAY FAR FAR AWAY FROM DER DAU.

That’s awful. I would think your cc company would support you 100% w all the great documentation you have. You might try filing a complaint against them with the Attorney General’s Office in the state they are in. Thank you for alerting us! Good luck.

The cc co has reversed the charge back off my cc card for the second time. I believe that’s what triggered his call yesterday.

I’ve reported the transaction to the Division of Consumer Fraud in their home state of NY as well as the Div of Consumer Fraud in PA, where the transaction took place.

one thing that they appear to be Very constant in is Poor customer service, when they make an error its not their fault but yours

One should NEVER let the threat of legal action dissuade you if you are right. It took two years, but I won a legal case against a clinic organizer (six visits to court) --first she claimed to be an attorney herself and tried to threaten me and the other 10 people she defrauded (took our money, didn’t hold clinic) with legal action if we went to social media with claims against her. I checked her out, she was not an attorney --I sued her in small claims court. She hired an attorney. He and I went head to head 5 more times before he withdrew after losing every match (he tried a bunch of side steps --wrong defendant, wrong venue, signed release saying no legal action, judgment set-aside etc).

Other than being in the wrong to take my money --the second mistake the organizer made was not knowing that I have two kids who ARE attorneys. While my little $300 case was not something they wanted to take on, I did get a ton of legal “hints” to pursue successfully. # 1 was --when you are right, there is no defense. Just keep telling your story and showing your evidence.

In the end I recouped $760 (my loss and court costs). The attorney she hired said, on his way out, “You should have been a lawyer.” He lost every single motion he made.

I wish I had done More homework before making the plunge. The majority of reviews on Google are positive. BUT, I posted a Negative review on Google and apparently I’m the only one who can see it!!
Soooo, Google reviews are Not impartial/unbiased.

I made a post on my FB page and they removed it as being “injurious to a business”, so I guess Der Dau complained

I posted the photo of my new boots on DD’s page and they blocked me.

So here I am.

He contacted me with threats of legal action because it appears as though my dispute with the cc company is going to be successful.
I was a paralegal for 14 years before hubby and I bought our farm. I know a few things. He’s not going to bully me into accepting his poor product.

My first thought was that this might have had something to do with the change in leathers: https://www.justice.gov/usao-wdny/pr/downstate-man-sentenced-trafficking-prohibited-wildlife, but no, you definitely still have protected (but perfectly legal, if the leather is imported/exported correctly) species on your boots if the leathers are real.

In any case, I get the feeling that this company has all sorts of issues. Sorry you’ve run into trouble and I hope you’re able to get your money back.

As a paralegal, you have probably experienced the “fear of court” that seems to pervade people who are not “in the business.” I think there is “fear of hospitals” for people who are not in the medical profession; and “fear of school,” for those who don’t work there. One of my kiddos said, “We have small claims courts so people don’t take sticks and beat each other in the streets!” Of the 10 known people who were promised a clinic and paid money, only two went to court with me (I could not represent them, they were my witnesses and I did get them witness fees that matched or exceeded their out lay.) The others had various reasons, but boiled down to they didn’t want to go to court.

Wow.
So sad that just making what they were paid to make is not happening.

The part that makes it extra strange is the lack of some simple kit you bought along with the boots not being sent. No one had to try to make that to fit, just toss the parts in a box and mail it.

Nope. I wrote to the Vendor Chair of DaD and received no response. Twice.
Interestingly, I wrote to the Vendor Chair of the Devon Horse Show as they also vend there, SHE responded. She said she forwarded my email to the DaD chair and then followed up with me to ask if they ever responded. (Thank You for your effort, but no they didn’t).

It’s been a mess from the Get-Go. Since we were at a show, he was supposed to email me the invoice. That I assumed would detail the order. Never got it.
He’s hiding behind a no refund policy that I Only saw After I paid with the credit card and the cc receipt was auto-texted to me after the fact. My research shows that in order to be enforceable, it must be prominently displayed.

I find this odd. I did not think reviews were filtered. I have posted plenty of truthful, unpleasent interactions with businesses and they are all posted. Sometimes it takes a bit for the post to show I have had that happen even with a good review. I did google Der Dau reviews and your Yelp one is up along with a few other reviews. Don’t forget to post on BBB. I distantly know the president of DaD… do you want me to see if I can bring this to her attention. Or just reach out to her directly, she’s on the website.

Its Small Business 101, especially in the digital age not to get into a public fight with a customer, whether that customer is right or wrong.

I’m in the business of making high dollar custom items that people are emotionally invested in. Stuff happens. We fix it, client is happy. Orders again in the future, tells their friends. We don’t fix it, client is unhappy, never orders again, tells their friends.

You’d think it would have been less effort on the whole just to make these right for you after your first complaint. Says to me that they lost your measurements and are guessing. Compounding incompetence with unprofessionalism.

Most review sites use some algorithm to try to weed out reviews that may be fake, scams, coming from those with ties to the business, violate some terms of service etc. It’s all automated. You also see this on Yelp and the like. Unfortunately this can also make mistakes and sometimes blocks genuine reviews. Very good and very bad reviews seem to be most often affected. Having a link within your review can also be a big red flag.
