First of all I cannot believe this discussion has gone on for 88 pages.

Secondly of all - an issue I’ve already brought to life - it is freakishly hard to take the original EN demand of a name change serious unless they boycott all European Events next to a big house/castle full stop.

Third of all a post I landed on by accident when randomly heading for a page in this mega thread made me search for the article in New York Times which leads me to the following question. WTF is this?

According to data from the United States Equestrian Federation, the organization that governs American horse sports, almost 90 percent of its 185,000 members identify as white.

Are they seriously asking for this information when people become members? 😱😱😱

a: if the facts of the 1st Amendment are irrelevant, why did you bring it up?

b: “The point is that anyone can post offensive speech…as long as it is allowed in whatever internet platform they are using…and that speech is protected by law.” This is not true. This is a fundamental misunderstanding of the legal protection for speech.

I’ll tell you who my Con Law professor was and you tell me yours and we’ll take it to the two of them. Mine loves to address this exact issue.

Again NO STATE ACTOR = NO 1A ISSUE.

1A was brought up by either Mr. Glaccum or Mr. Walker somewhere in the midst of all of this. Clearly, they were angry when they wrote it. Maybe even infuriated.

People who bring up the 1st Amendment with little understanding of it make such fools of themselves. Sigh.

I think your second point in this post is the best summary of all of this situation: no need to cry for the LO, he comes out just fine: no noisy event on his property, no unhappy neighbors, no hassles, no skin off his nose. As pointed out before, many of the local events no longer run, so this is not outside the life cycle of a typical event of this size in this area. It’s a shame it ended the way it did, but the LO loses nothing and probably gains a lot of peace of mind and good will with the neighbors. He made the right choice for him and I wish him well with his land.

Do they ask for race on joining? I don’t know. If they do it isn’t for any nefarious reason, I hope, but a cultural one. The US is obsessed with measuring race, nearly every membership survey, government form, or other survey has a box to tick for what race you are. You don’t have to tick the box, but there it is…
It was such a surprise when I was living in Canada and the UK and the forms didn’t have that box!

I was responding to the poster who tried to school someone with an erroneous overview of the 1st Amendment complete with case law while also mocking her target and belittling their level of education. It was a spectacular fail.:eek:

While the “state actor” may be a test for admissibility in a court of law, it provides guidance for how courts have interpreted US law.

Again, no. No one objecting to or acting on facebook posts invokes anything related to the 1st amendment or courts interpreting US law or legal protection of speech. Again, who was your Con Law prof?

I am not debating Constitutional Law. I am using a SCOTUS decision to frame how the highest court approached a decision regarding the bounds of offensive speech…yes, where there were a “state actors”. In those cases, the Court opined that offensive speech was protected.

The issue I was addressing here was the indignation over “offensive” posting on the internet.

I simply used the SC decisions to illustrate how offensive speech was treated by the SC…yes, when there is a state actor. And suggested that if the SC can protect offensive speech …where there is a state action… perhaps people who were offended by some Facebook posts should just simply ignore the person.

I am not getting into a ConLaw pissing contest with you. I deal with attorneys in my professional work…and…they like to argue.

Yep. Iv’e always thought “Woke” was a dog whistle for race baiters and race hustlers black and white. Just like “systemic racism”, newly invented term to keep the concept of victimhood alive and dependence on the “woke” handlers permanent, possibly the cruelest and, long term, the most damaging form of racism. Tip O’Neill said all politics is local. How many of you have friends that you would consider “systemically racist?” Thought so. So once again the arbiters of just how and when and why we should all be offended by some make believe racism are in reality doling out a huge dose of it themselves by claiming that they, privileged whites, have determined for the poor unaware POC that they should be offended by the name Plantation and vigorous action is required. Insulting beyond belief. I don’t blame the poor LO for kicking us out, I just hope the lesson has been learned and the mistake not repeated.

hahaha! A good argument is, indeed, enjoyed by many.

I’m an attorney and I actually don’t like to argue. My main job is to avoid arguments at all costs and get my clients’ deals done.

I do, however, have strong feelings that when things are stated - esp in such a condescending and know-it-all way while mocking the target of the lecture - they are presented correctly. That is all. Talk about your glass houses - eesh!

The misunderstanding of the general public about what the 1st Amendment is and isn’t, what it does and doesn’t do, and its implications with respect to all sorts of situations, are never-ending sources of frustration (and occasionally amusement) for people in my field.
