Since this is a horse BB, I would compare it to somebody at a horse show who stands at the ingate for 10 minutes while the ring is empty and the judge is waiting for the exhibitor to start. Lol.

They get a default judgment against them. Whatever the opposing side asks the court for.

I have been aware of JK’s defense and “clean up on aisle 5” of LK’s behavior for years. I will admit I had no idea how involved both parents were in their daughter’s behavior and actions until the past six months and my awareness came directly from them! It is unimaginable to me what lengths they have gone to and are willing to go to continue the facade of decent behaviors for their daughter and their family. The email to Sceusi reeks of desperation and inability to follow the legal process. Who does that? I don’t comprehend this better than anyone else behavior.

Nagel’s reasoning for not complying with the request for phones and other information is incredible to say the least! Of course RG’s phone is important and why the State of NJ ignored whatever is on those phones that the Kanareks are now frantically trying to hide is certainly puzzling, isn’t it? Hopefully Sceusi will also see the absurdity of Nagel’s request and order Schellhorn to turn the devices and other requested material over to the defense teams.

The worst that can happen to the plaintiff would be LK’s suit gets dismissed. Sanctions can also happen, depending on how annoyed the judge is.

At best, the judge is now annoyed and it’s going to affect every ruling going forward if they think the plaintiff and her attorneys aren’t playing in good faith.

So in regards for them wanting more information (potentially the recordings), if they don’t comply, the judgement is against them but is that the civil judgement? Or just a judgement in regards to this stuff. Is there possibility for charges or anything?

Aww, come on! They did comply but it was lost by several law offices! /s

They could lose the entire case if they keep it up, not just these motions, and Michael could be granted whatever damages he asks for. JK’s ex parte attempt was a spectacularly bad move if there was any question about if the judge wasn’t 100% bought off.

That was their legal verdict. I don’t know why they selected NGRI but in a strictly legal sense that’s what they said.

I’ve said before I wondered if maybe they just wanted a person to be held responsible for a shooting. Maybe it was the long weekend. Maybe they truly felt he was.

It would seem to me that all this word salad and delay coming from the Kanarek Klan is doing nothing but making the judge angry. Especially for a suit that LK initiated. This whole family really feels they are so above the law that is it really repulsive. Especially with JK being a lawyer.

I recall seeing that as well - but there was no way to determine the origin of said photo. I also believe I saw it on the actual page and it was not a screenshot – maybe through a link that LLPR provided here during a tirade? I would not go to her FB page otherwise. But that was a while back and many frenzied SM posts ago…

Having just caught up on this thread, I am somewhat bemused by the notion that some posters here are simply part of one big Borg mind meld… unable to form an opinion or thought of their own. How very… odd. And not true.

Equally odd is the idea that LK never swears/swore in any of her endless rants on SM over the years - that was definitely a snort-coffee-out-my-nose moment!

It seems to me - IANAL but just a lowly barn scrubber - that the Ks have repeatedly shot themselves in the foot/feet with all their delaying and posturing and emailing… and the only people that can blamed for that mess is ~ drumroll ~ themselves.

Jonathan Kanarek is still a registered attorney with the state of NY and can renew his registration in a month. I don’t know why anyone would throw down the money to be an attorney in good standing between 1978 - 2022 if they weren’t using their license, but IANAL.

ETA: I thought it would cost a lot more to renew. There is probably more to it (CE, ethics classes, etc.) but I really thought it would cost at least 4 figures annually.

Note that all New York attorneys are required to file the biennial registration form, either with payment of the $375.00 fee , or with a certification of retirement. When do I register? A biennial registration must be filed within 30 days after the attorney’s birthday, in alternating years.

It can be privileged if the communication takes place when counsel is acting as an attorney eg providing legal advice. However the conversation has to be intended to be private, as it would be between an attorney and a client.

If I’m talking to you about our horses, even if I’m an attorney and you’re my client, that conversation isn’t privileged just because I’m an attorney. I’m not acting in capacity as an attorney.

Wow, that’s really not expensive at all.

Funny that it’s based on the person’s birthday. But I guess that would keep all the registration paperwork spread out throughout the year, instead of piled up around January 1st or whatever.

While the renewal fee is not a huge amount it can be quite costly to do all the required CLE. New York requires 24 hours for every two year renewal period. While you can find some cheaper CLEs the classes from the top providers cost $150 to $300 or more per hour.

Moreover, registration fees for attorneys are substantially higher in comparison with the registration fees for other professions, and there is no indication that the fees for the other professions are starting to catch-up. In fact, no other licensed professionals in New York State are subject to registration renewal fees as large as the amount attorneys must pay. The current biennial registration fee for attorneys is $375, and attorneys also have to pay additional fees to attend mandated continuing legal education courses to keep their licenses. By contrast, Certified Public Accountants pay renewal fees totaling $292, and psychologists pay re-registration fees totaling $179. Notably, unlike lawyers who are required to re-register every two years, the State Department of Education only requires other professions to re-register every three years. And, perhaps more importantly, the registration fees for the other professionals as published on the New York State Education Departments Office of the Professions website indicates that the registration fees for other professions remain exactly the same as two years ago. So, in recent years, other professions pay less, have to register every three year and have had no increases.
