I think this is the Florida statute you want. The 2nd one addresses felony cruelty.
Yours doesnāt work because the Defendant will argue it was not his āINTENTIONā to cause the horse to fall. I bolded the part i think renders this statute not applicable. The statute reads:
(5) A person who intentionally trips, fells, ropes, or lassos the legs of a horse by any means for the purpose of entertainment or sport commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this subsection, the term ātripā means any act that consists of the use of any wire, pole, stick, rope, or other apparatus to cause a horse to fall or lose its balance, and the term āhorseā means any animal of any registered breed of the genus Equus, or any recognized hybrid thereof. This subsection does not apply when tripping is used: (rest not important)
How did he get away with that? I mean - there is SO muchā¦ it is horrific - I know I am repeating what everyone is saying ā¦ but My God!

The ZfDP (Zuchtverband fĆ¼r deutsche Pferde = Breeding Assosication for German Horses) excluded Sankdbrink and Klieber! Thatās a huge accomplishment! They were members of the ZfDP. Although itās not one of the main BAs (like Hannoverian, Oldenburg etc.) but it IS a BA excluding these people. Right things start to happen. If the public pressure rises, hopefully more BAs and FEI, USEF, FN etc. will exclude those people from all training, competition and breeding events!

But the really sad thing is that even if he gets dragged into court for one specific instance, photos, videos, and statements of other alleged instances will not be allowed into evidence because they will be deemed āprejudicial.ā So he will get off againā¦

Not necessarily. They could prosecute each thing as a count. A defendant can have multiple counts.

Blue tongue was Kittel (Sweden) and Helgstrand (Denmark). Both had such incidents in the past.

Then the owners of those other horses would have to come forward and be willing to testify and (hopefully) provide some sort of proof - right?
I wonder how many of them would be willing to do that - like the owner of the horse he allegedly punched holes in with a pitchfork, or the owner of the horse whose bridle he allegedly put a screw into on the underside of the noseband. And God knows how many other instancesā¦

The entire point of the apparatus is to cause the horse to lose its balance so that it steps in a certain way to offset the impact of the device (and not fall over). That is why the horse quickly snatches the legs back down as it does - if it kept going it would trip. Usage of the device is intentional to cause the horse to trip or to be harmed if it does not position the feet in a certain cadence, rhythm or motion.

And Iām now wondering if the repercussions from this will also trigger FEI to go after people like Ulf Moller, who allegedly rigged up a contraption with a piece of elastic cord going over the nasal bone of a horse being ridden in a lesson with him, so the horse wouldnāt pull or go in front of the vertical because its rider was too ineffective to keep it āthroughā without such a device.

Letās hope they are successful I believe Martin Plewa mentioned that they are a GmbH and it might be difficult to exclude a GmbH

I think there is unprosecuted abuse all over the world, not just the US. Animals have no voices. Some famous trainer said that if horses howled like dogs the sounds at the shows would be so chilling and distressing that horse shows would be immediately banned.
I had a trainer, a prominent person, many years ago who imported a very nice horse from Germany. She was able to get the horse inexpensively because it was covered in cigarette burns. It needed A LOT of mental rehab. The prior owner (in Germany) was a young woman with an eating disorder. She sold the horse because she had to go into a facility for her disorder, not because she was prosecuted for the cruelty of putting her cigarettes out on the horseās hide.

I wonder if it could be argued that any reasonable person would know such a contraption could/would cause a horse to fall or lose its balance- or alternatively,(oops as already noted 
it is used to purposefully cause the horse to lose its balance and change its action to compensate??

Let me say that ANYONE connected with these horrible abusive OUTTED trainers should be investigated. Organizational abuse does not happen in isolation. There is not one fall guy. Even the danish organization, which protected AH for so long, is going after the assistant trainers on the video. Once these people are out in mainstream, this disease has a chance to spread!

Well it wasnāt training as he was there only 45 minutes before CP flipped him. Its was an evaluation. Just thinking how to break the NDAs.
