Stewart vs. Chungungco
No. The sale being discussed (that appears terribly sketchy) was Exclusive. However, the trainer is auctioning the pony, Spellbound.
I know. But look at the date…There is no Monday, August 15, 2014

Well that IS strange. When I copied the same text (I think it’s back on pg 7) it said 25th.

I just looked at the page again and it does say the 25th
So you don’t have to have a court order in MD? So any trainer can say “Hey Ammy Owner owes me $XXXX so I am going to the court house and telling them I’m auctioning off her hunter in 30 days” … I get what VXF is saying, that makes sense. But it doesn’t make sense to me that a barn owner can go auction a horse all willy nilly because she SAYS she is owed money.
Many years ago, maybe 30, I had a young pony boarded with a pony breeder in Maryland. She decided to do something very similar. She made up a completely fictitious amount, hired a lawyer and set up an auction. I contacted the lawyer she had and sent documents showing what was to be charged and how it had all been paid. She told me too bad… I lived very far away at the time and couldn’t get to the sale. Luckily some friends did and bought my pony back. So yes in Maryland they seem to be able to snatch and sale them very quickly and illegally without any repercussions.

From the email I received a while ago:

VB, it does indeed say Monday August 15th 2014!!?

I received a email on Thursday which lists Monday, August 25.

Do we know that the PPE itself was sent to the insurance company. Someone intimated so but I presumed otherwise. I’ve never had to submit one.

Please reread the pre purchase exam. The horse started of slightly uneven a grade 1 out of 5 and “The horse warmed out of this unsoundness quickly. It was not observed again after a few minutes of trotting”. It Remained sound though out the remainder of the exam, through straight line, circles and lead changes. It is not unusually for horses that are in heavy work to start if a little creaky. When I get moving sometimes it takes a few minutes for me to warm up.
Just thought I’d add that I’ve had experience with active suspensory injuries that present just like that: NQR for first 5 min or so and then sound. In fact, I’ve seen it enough that when presented with the same type of situation, I think either arthritis or suspensory. In this case, the horse had an active suspensory and just about anyone who isn’t trying to look the other way would’ve connnected the two.

You may want to consider using anoher vet. This one seems at best to be very liberal with her interpretations of PPE results when completing an insurancee questionnaire…or at worst is a liar.

So the insurance company was still not out any money – major medical, mortality you name it, they would not pay. Non disclosed conditions, excluded conditions, mortality – whatever. The result seems to be the same.

After that I canceled my other policies – no point in wasting $$ that way. There are enough other ways to waste my $$ in horses.
Ugh, that is terrible! So sorry for the loss and for the insurance co’s determination. :frowning:

Don’t know if it was posted. RMHP posted all of the documents filed between the parties

Those are some huge invoices, a little hard to understand why KS would continue to offer services until the balance supposedly got over 200k. I will say she seems to eat very well at horse shows

Wow. First thing that comes to my mind regarding KS, the farm is “dirtbag”. As for the vet, something underhanded going on. Though technically she can not say what the abdominal scar is from, there is one and she noted it on the PPE. At least I know another 2 people to steer clear from if I am ever in that neck of the woods.

Kim Stewart is saying that there are $207k worth of bills that piled up that were never paid. But based on the story that MC is telling, she was paying regular bills and owed somewhere around $67k. She then was privy to the bad vetting and shady bill of sale on the purchase of Exclusive and was in agreements with KS that the 50k she spent on the Exclusive horse would be credited to that amount based on the wrong doing. MC was under the impression these things were being worked out and then she sees a letter in the mail stating otherwise?

Whew…this is messy.

Seeing those invoices reconfirms that I will never play at that level! Good lord it is shocking when you see it laid out in black and white, even though we all “know” just how expensive this sport can be. I am so glad I am satisfied with my little rinky dink level of competing, lol.

I think it is terrible for the sport that these deals occur during sales. I wish owners (even the pony moms and dads) would 1) insist on everything in writing and 2) actually READ and REVIEW the documents they do receive! People playing at that level are most likely successful in other ares of their lives- I am sure they wouldn’t sign an employment contract without reading it, or make investments without at least reviewing the documents, even if they don’t understand every detail. Why spend so much money each year on a HOBBY without reviewing with a more critical eye?

One thing that stands out to me is how there is 15% commission included on Exclusive, but he is listed in the wire/bill of sale and USEF DB as belonging to GWF. So, seems a little absurd to pay a commission on a horse you don’t in fact own… (I do understand that the ownership issue was found out later)

IMO? Sounds like the worst combination met up: shady trainer + client who’s in above their head. The fact that they couldn’t afford to buy Exclusive is a red flag. They probably received bad advice, but this was when the logical side should’ve stood up and said, “hey, we want to move up to jr. hunters, but let’s wait until the end of this last year on a large pony then either sell the champion pony for big $$$ or lease him out, then use that money to buy a jr. hunter”. But they just kept paying and paying…

That has always puzzled me, as well.

Salamander Resort and Spa? Talk about high end places to stay! From my experience, I know that when things are smooth between trainer and client details are not explained properly and everything is left very ambiguous on purpose. After the bills are delivered the issues surface. MC thought she was getting catch rides for all those ponies and in reality she was paying for everything even the pro kids riding the ponies. What a scam!!! but I heard of it before.
the reason that these so called smart people don’t read or question things before is because the whole relationship is smeared with an aura of friendship that is very confusing. I think parents think trainers actually care for their children(I’m sure some do. Don’t jump on me) but the majority don’t. Just passing clients, like reruns of old movies.

That was my thought too… pretty sure it was upwards of $700-900/night over Upperville week… could have found a cheaper place to stay for sure!
