@MHM I was referring to full metal jacket bullets vs hollow-points, which are evidently restricted in NJ, something I was not aware of.

I don’t know, it really depends on each individual juror. I was seated on a jury that the defense tried to stack with what I assume they though were “compassionate” jurors. One priest and 2 nurses, one of which was me. The crime was vastly different than this one but the attempt to stack the jury was an absolute failure. There is research behind jury selection but it often comes down to a crap shoot.

FTR don’t claim that you stole a metric sh!t ton of high end shampoo products because you live at a Catholic homeless shelter that doesn’t supply toiletries. Especially when the priest on the jury, along with members of his congregation, make it one of their missions to collect and package toiletries to give to homeless men who live at the exact same Catholic homeless shelter. Oops.

I would think that the judge in the civil lawsuit will either a) dismiss it as nuisiance, or, b) not give it a date until after the criminal case has been heard. They aren’t going to be able to get the evidence being held in the criminal case for the civil case until its done, so the civil case seems very suspect to me.

Apparently, LK doesn’t have a clue where the gun came from, and its probably making her crazy not knowing all sorts of details about the case she’s not privy to anything the prosecutor or defence attorneys are doing. She can sit in the court room and listen to the trtial, and might be called to the stand as a witness, but she doesn’t get to have any information about the case being brought, as she isn’t a party. Its the prosecutors’ case, for the people of NJ, not hers. But she doesn’t know where the gun came from, so she’s naming myriad people as possible owners of the gun. So there’s been no arrest. People don’t get arrested in civil cases, I don’t believe. If there was, she would know who owned the gun, and would need to rewrite her acusations towards myriad gun owner does.

She’s probably bringing this civil case now to get all these details, But the prosecutor for the criminal case isn’t going to inform her of anything he has for his case, and information about the gun and where it came from is his evidence. Its his case, not hers But the attorneys for all the civil defendants aren’t going to be able to mount any kind of defense until after the criminal trial, when the evidence they need is released, so she’s shit out of luck. There won’t be any civil trial now. The judge will probably dismiss it now, and make her refile after the criminal trial is over.

My opinion.

In re: lost wages claims. I have a family member who is a retired high level personal injury attorney and dealt with people who were permanently disabled; and in his cases, there were actuaries to figure out the lost wages piece, based on previous employment, level of education/skills, overall health/predictable life span, age, gender, market in that part of the country, etc. Way more science than art. The plaintiff doesn’t get to pick a number out of the air for lost wages; there are accepted methodologies for calculating that number. Also, reaching deep into my memory here; (I’m not a lawyer and I don’t play one on TV), emotional distress claims are difficult to collect on unless there is physical manifestation of the emotional distress. That is, you might collect on an emotional distress claim if the distress also caused ulcers or tremors. Collecting on emotional distress without physical evidence is very, very difficult. (So posting selfies all over social media of you happily going about your daily life is a bad idea if you’re later going to try to claim damages for emotional distress.)
