Apiro Dispute - He's Going Home

Glad to see Apiro finally gets to go home to his rightful owner. The court docs are an interesting read! Yet again, another person gives the industry a bad name. :frowning: Congrats to Summer and Silver Creek on getting him back!

I aw that go by on FB . Also sounds like they arenā€™t releasing details about it yet. But was he leased to someone and they didnā€™t want to return him or something?

Man. Maggie Fullington is a real piece of work. Looks like Summer has: lost years of selling breedings/semen from Apiro and has spent tens of thousands of $$ on legal fees. All the while, MF has had the stallion, has lied about her income from the stallion, has been taken to court by others for non payment of various items, had 2 attorneys petition the court to be allowed to quit representing MFā€¦

Does MF have any verifiable defenses to these issues? Is she still involved in the H/J/breeding worlds?

Good for Summer for seeing this through to the end. I hope that breeders will come back to Apiro when they realize that an honest and competent owner is involved. I would guess that there are breeders out there who paid for semen and never got what they expected. I hope they will also take MF to court.

Polydor, according to the court documents just released, Maggie ā€œpurchasedā€ the well known stallion and his frozen semen and then never paid for him and also never paid the storage fees on the frozen semen. As breeding fees were coming in for Apiro, the money was supposed to be going to the seller to pay down what was owed on the stallion. Maggie Fullington continued offering him at public stud and never forwarded any of the money to the seller - almost 50k in breeding fees. In my opinion, Silver Creek was more than patient during the entire situation. Glad he is back home.

There is a summary of the proceedings and a ruling by a Magistrate assigned to the case by the court (it happens when cases are road blocked and the court does not have the time or patience to sort it out). The Magistrateā€™s ruling is upheld by the court 99% of the time. The Magistrate found 100% for Summer on 11/9 ā€“ which is when Summer was finally able to come online and announce the result!. MF was on her 4th attorney (for this hearing ā€” Attorneys #1 - #3 had all asked, and been allowed, to ā€œwithdrawā€. A petition to withdraw is granted for a number of reasons, but a big one is because the client has not paid them. She still did not show up at court.

This woman has huevos.

There are no words for MF! Terrible person. Unfortunately people keep getting involved with her so she keeps on going

This is such a mess! I adore my Apiro filly, I had no idea Apiro was wrapped up in this bad deal. Smh, people are Shadyā€¦Iā€™m glad heā€™s going back to Summer

Thank you everyone! We are very excited that Apiro is finally coming home and we are looking forward to making him available to mare owners for 2018. In fact, he should be arriving shortly!

We are glad to see Apiro going back to Summer too. I am so grateful I had the opportunity to meet him in person at MF shortly after he arrived-- pre what we came to know of her professionalism. You could tell he was unhappy. Never handled without a big crop and had his stall door padlocked. I am sure he will be so happy to get home. Big hugs for that big boy.

I just purchased a 2018 breeding to him and am pretty excited. I am already impatient and we wonā€™t even start the process for another 6 months! Itā€™s going to be a long year and a half.

Oh poor guyā€¦I met him when I bought Amazing at Silver Creek and he was a doll baby with big floppy ears. Hope heā€™s happy back at home <3

She was sued againā€¦. Court made a default judgment against herā€¦. Now sheā€™s going to have to pay since a writ of garnishment was approved by the court. The gift that keeps on giving I suppose :joy:
