Bad feed leads to lawsuit

Aidan O’Brien and his son Donnacha are among 10 plaintiffs associated with Coolmore and Ballydoyle who this week began the process of suing the animal feed supplier Glanbia over the contaminated feed controversy on Prix de l’Arc de Triomphe (G1) weekend in 2020.

The issue of bad feed leading to a lawsuit can be considered in different ways. The first way is that the person who is using the feed can file a claim in a court of law. The second way is that the feed company can be sued for negligence. In some cases, the feed company can also be sued for fraud. In these cases, the court will consider all of the factors that are involved in determining whether or not a bad feed leads to a lawsuit.

The factors that the court will consider include the following:

  1. Whether the person who is using the feed knew that the feed was bad.
  2. Whether the feed company has given the person who is using the feed any warnings about the feed being bad.
  3. Whether the person who is using the feed used the feed within the time frame that was specified by the manufacturer.
  4. Whether the person who is using the feed followed the directions on the label.
  5. Whether the person who is using the feed had any knowledge that the feed was bad.
  6. Whether the person who is using the feed had any knowledge of the risks associated with using the feed.
  7. Whether the person who is using the feed knew that the feed could cause damage to the person who is using the feed.
  8. Whether the person who is using the feed used the feed without having read the warnings or instructions on the label.
  9. Whether the person who is using the feed used the feed in a manner that was unsafe.
  10. Whether the person who is using the feed used the feed in a manner that was negligent.
