That’s the way I see it. Also, RC was going to go to the farm the next weekend, but after talking to MHG, came on Aug 2. MB asked her for the gun.

It’s just not self defense when MB procured a gun and went into her vicinity.

I thought the rebuttal expert was quite effective.

I don’t see a “Not guilty” verdict. (Also, don’t forget the gun charges.) I think possibly the second attempted murder and second gun charge might get not guilty on the grounds that it’s not proven that the third shot was aimed at RG.

I think it’s going to be “Guilty” or “NGI” on one count of attempted murder, and guilty on one count of the gun charge.

My heart is breaking for MB…actually has me in tears for what he’s gone through in his childhood and then to have these 2 demons feed off of that to destroy him…I in no way condone shooting a person but I can not honestly say the thought wouldn’t cross MY mind if I suffered the same and was in the same situation…I’m bein totally honest and I think you all know what I mean.

What would the sentence be on aggravated assault? Or recklessness?

seems dangerous…honestly I think it would better to get insanity so he could go to a facility until he is doing better. An assault charge means jail time, although he may get time served.

Do they do time and a half for time served in NJ?

Legal peeps … if they’re considering adding lesser charges, does that mean they are concerned they don’t have enough to convict on the original charges? Or do they do it all the time regardless?

I find it completely unbelievable that JH managed to steal LK’s phone, happened to know her password, used it to look of things he wanted to frame her for searching that involved threats against his boss, and then put it back and nothing came of it until after the shooting.

not a lawyer but I have seen this many times. They want to make sure something sticks, and I’m getting the vibe the judge isn’t going to let him walk out there free.

I thnk the judge is trying to HELP him get off on a lesser charge because the jury may only have ONE option if not given other options. MB defense is failing him by not taking the lesser, imo. I think it’s only like 18 months for that charge.

Can anyone explain, from a legal standpoint, the Defense’s position NOT to include any lesser charges as options for the jury?

He doesn’t know what he’s doing! He’s going for ALL or nothing and he’s probably maybe going to lose! I hope not but he should have give the jury a LITTLE wiggle room to work with!
