Clearly my understanding of this is limited… that’s the whole thing about you can’t get tried twice for the same crime?

Has anyone clarified if MB goes into an institution if he’s found not guilty by insanity?

That will be the judge’s decision based on medical expert advice.

Ineffective counsel. They could easily argue that. But prosecution could appeal.

So, since this was objected/sustained, obviously Rob has to answer about this. That’s another opportunity to clarify the details or see the lack of consistency in their accounts.

I sort of think someone said on a previous thread that they could turn around and try him again on a lesser charge, but I won’t swear to that.

Is NG is automatic insanity in this case? Or is there a NG and not insane…

OK, I’m mostly listening rather than watching at this point, so if the jury left, I didn’t see it.

Did anyone else notice LK shift her eyes when asked if RG was a US Marine? I’ve been told he never finished basic training.

This has probably been mentioned/discussed already somewhere in these threads but could the reason that MB doesn’t remember the incident be because he was beaten in the head for 7 minutes??

MB would likely go into supervised custody for a period of months or years, with required therapy and such, before being released back into the free-moving population. Upon release, he would still be under Safesport ban, regardless of verdict, unless it comes to light that someone else in fact shot LK, which would obviously nullify that sanction.

Why not? It sounds like the state has preserved objections properly?

Along with having his head pounded into the pavement AND choked. It’s a true miracle he is alive.

Re: institution if he is found not guilty by insanity-

My experience was not in NJ, but it would be incredibly unusual for him not to be committed indefinitely if this defense succeeds. If people succeed in this defense, their mental issues would have to have been treated/receded, with a high guarantee they are not a danger to self or others, to avoid commitment to an institution. Most people who succeed in this defense end up committed for longer than their prison sentence would have been.

True, unless it can he determined she was shot during a struggle, which seems to be where Bilinkas is heading. There is still plenty of questions about who actually had the gun.

I thought the judge said there was no evidence it happened for that long?

Is blinkas trying to say HER phone was broken Before shots fired? That’s why she couldn’t call 911 from it
