I laughed when it came out that the Def expert was often used by Prosecutors too. Made me wonder if that pool of experts is limited and Bilinkas, being the specialist that he is, made sure to grab the best guy first, leaving Sir Talksalot for the Prosecution.

Definitely could be - that happens a lot. We all know who the good ones are in civil practice for my particular (main) area of the law, and we snap those ones up quick.

He was so bad. I couldnā€™t believe the state hung its hat on him. I honestly canā€™t think of a time when Iā€™ve seen one that bad on direct. (Iā€™ve definitely seen experts fall apart on cross).

And honestly, that was one of the moves by Mr B that impressed me a lot - bringing in Dr Hasson to work with MB after the Moustache spent 13 hours with him, and Dr H was able to rebut that manā€™s testimony so well. They didnā€™t need a 2nd expert after Dr S, but that was a great move.

I would try to avoid a long and expensive legal battle if possible. I would exhaust all other possibilities before formally filing an eviction notice. Funnily enough, thatā€™s exactly what MB did too.

I also think Bilinkasā€™ fumbling in the beginning then getting better and better as the trial progressed was performance art.

Then the emotional, powerful crescendo at closing.

Masterclass.

As an aside, the civil case will be interesting. I think someone mentioned that a lot more evidence may come in during a civil case, and thatā€™s probably true - there are a lot less guardrails involved, and judges tend to let things in.

There isnā€™t a specific medication for those with BPD, at least not one thatā€™s FDA approved specifically for BPD. That said, there are lots of different medications available that are used to treat the symptoms of BPD.

I agree. I canā€™t fathom a civil attorney watching the train wreck that was LK on the stand and thinking a repeat is a good idea. Except, the civil attorney did call this jury insane. So thereā€™s that.

If it actually makes it to court, it will be fascinating.

Hahaha - I had to dig deep during the pandemic for things to watch, and I did watch that one again - the ā€œbendā€¦and SNAP!ā€

Actually, the one they show in some law schools for Civil Procedure is ā€œA Civil Action.ā€ Fairly accurate depiction of a civil case. Canā€™t really think of a criminal one, though!

Well, I can say this much - even though big awards get in the news, juries do not like to give out free money. They just donā€™t. And, discovery will be very interesting, for sure.
