But I’m more eye-roll-y because of a brand new profile posting 3 new threads about the same person, buying a horse sight-unseen. I don’t even care enough to ask the usual questions and engage.

It’s like watching Judge Judy having to endure someone crying that they bought a car that turned out to be a lemon. But didn’t get a mechanic to check it out. You just fast-forward through those episodes cuz you know the outcome.

I don’t know, how many people bought TBs sight unseen from Throughbred Sport Horses. I know someone who did, without guidance of a trainer, because they were naive and felt a contract would protect them.

Ok. Still doesn’t excuse one the oldest expressions known to man. I mean, it originated in latin fercryin’outloud:

I don’t care if there’s a “guarantee” or quote/contract/quote. One alwaysALWAYSalways gets a pre-purchase exam performed by an unbiased party.

Like I said, the TB sport horses people duped dozens of naive buyers. It happens.

I agree. The first step would be for the OP to discuss the the part of the contract has been breached, instead of posting a cheap hit and run post here.

If you have a gripe then make your case, like any intelligent adult would do.:wink:

Well, for starters, both only work if the statement made is false:

But what about an anonymous person making unprovable claims of wrongdoing by X party?
Can X party approach website owner where claims are made to pursue damage, if provable?
(not sure how any of that would be provable).

I seem to recall something about making statements on the CoTH boards wasn’t allowed unless legal action was in the process of being taken… back when the Fallon Blackwood thing blew up.

And then the injured party has to take it on themselves to file a civil law suit at their own expense. For which they need proof who the writer is. And all blog type websites have a disclaimer about views aired.

The burden is on the injured party to prove the claims are not true in a civil suit. It’s a high bar to jump for most low level business disputes especially if there is any dirty laundry to hide.

Anonymous online reviews of businesses are so common these days, I don’t hear of too many restaurants launching libel claims against Yelp.

She does have what seems to nice horses for sale sometimes. And several displeased buyers. Sorry OP, I hope you hire a lawyer.

The people who I know that bought a horse from them would have struggled with that. It’s how scam artists are still out there. A lot of people aren’t internet savvy enough to run a quick search on a seller.

Kim O bought said gelding from our farm as being lame. It is stated right in the contract that she is buying him lame and no warrantees are being expressed with him. I had pulled him from the market because of a horrible abscess and I was about to get married (Hence my last name change! and she knew this). Kim reached out to me and said she would take the gelding even though I made it very clear he was not sound. The price was of course reduced a good bit. She chose not to have a vet out to do a PPE, the only person that looked at him was my farrier to try and drain said abscess.

Fast Forward:

Kim gets gelding, drains abscess and loves him. Sends me several texts about how good he is etc. Then while I am on my honey moon texts me and said he kicked her and its not working out. I then go into panic mode because I owned this gelding for almost a year and he did no such. But I am also aware horses will do dumb stuff so I offer to help when I get back from my honey moon. After returning home I told her I needed some time to get things in line. In the mean time she wants to trade for a horse a client has at my barn and i offered to trade another gelding I owned. I talk to client and wait on possible customers to decide on horse and I am just about to arrange for the trade to be made when I decided to ask for some pics/video of him moving about. I dont want a starved horse or broken leg horse back. The breaks come on and she gets super defensive. I call her out about only wanting to return him because he is lame and she starts bashing me and admits it was easier to not be upfront and honest rather than to just make stuff up about how bad this horse was etc.

She also has no xrays or anything confirming horse has any broken or chipped bones just what her vet thought might be a possibility.

And here we stand…

They won’t allow posts that accuse someone of criminal conduct without proof that action has been taken, such as a newspaper article, or a court document that shows that a charge has been filed.

You can say “so and so sold me a bad horse” but you can’t say “so and so sold me a bad a horse at gunpoint”.:yes:
