Breeding mare contract

Hello, I think this forum has some very good information from its members and would like to ask if any of you have a contract or agreement I could copy and adjust as appropriate for my own circumstances or as much info as possible, regarding setting up a Breeding scheme where buyers can choose a stallion and a mare from my stud to breed. I have looked at lots of lease agreements and stud contracts but finding it difficult to find anything where the mare stays at my stud, I do not want to loan her out to breed, she has to stay at my yard. I would like it to be as fair as possible for both parties but obviously cannot afford to lose out.

IMO this sounds like a broodmare lease with specific terms. There are a lot of them on the Internet. You can just add in that mare is to remain on your property and what is included in the lease fee: Full or pasture board, vet care, breeding costs, stud fee, farrier, subsequent costs once foal is on the ground etc, insurance if required etc.

I free leased a mare for my first foal I bred. I paid board, insurance, vet fees, stud fee for stallion of my choice, breeding costs and the mare stayed at the broodmare farm. I was responsible for additional board fees once foal was on the ground. It worked out well . My contract specifically said that I was the owner of the foal once on the ground.

It doesn’t sound as though it would be difficult to amend an agreement to state your specific terms. Good luck!

I would really recommend having an equine attorney look at whatever you come up with.

Someone tell me if I’m splitting hairs, but I think I’d be more inclined as a buyer to sign an in-utero contract on a foal, whether I chose the parents or not, than a breeding lease contract on a mare. Many buyers won’t want to be “responsible” as it were for your mare in your care. Certainly you factor normal expenses into the price of the foal, rather than “leasee” getting slammed with unexpected mare expenses and then worst case scenario, no foal to show for it.
