For all the Whiners out there…if you want to really do something for the horses in PA…I have checked with numerous equine lawyers and they all concur that a lawsuit can be filed in federal court…abuse of the horse does have a legal definition…and it can apply at the national level
2004 Washington State Supreme Court held in 118 Wn. App. 730, State v. Zawistowski, that Webster’s Third New International Dictionary 1621 (1969) definition of “pain” as "a state of physical or mental lack of well-being or physical or mental uneasiness that ranges from mild discomfort or dull distress to acute often unbearable agony."

So is that what you call people who try to protect horses who cant protect themselves, Whiners?
Action…where is the action…whiners complain but do nothing…not meant to insult but rather to insite into action.
I do not live in PA or for sure I would find a way to do it.
Get a group together and find a way to bring legal action to hold them accountable.

Agreed, this board has achieved some good things in its own weird COTH way…Gill exposes, cats got new homes, SB horses no longer in jeopardy (we hope) and Mrs DD cell #…
Well we didn’t find any homes for the cats on this board. I had released a couple that were very unhappy in their crate and they had the option of staying at my farm or leaving, they left. I also released 2 others that stayed, and one is deaf and her sidekick is just cute as a button and I named the deaf one (who used to ride on their tractor) Butterfly and the shy tortie is Firefly, they are the Fly girls. They are both irresistable and use the litterbox. But because Butterfly is deaf she needs to live indoors and because Firefly is dependent and shy she needs to live with Butterfly. Those are the 2 cats that need homes, but not barn homes. Butterfly did take a ride with me back to Elk Creek and really looked around but she snuck out of my truck when we closed the gate. Believe it or not, she then jumped back into my truck and I took her back to my farm. She’s an amazing cat. If anyone is local that would offer the 2 great homes in their house please email me at TruckParts19311@aol.com and if you can give them a better home than my farm (not hard to do) and indoors and maybe a ride in your car/truck/tractor once in a while then I’ll do my best to make it happen.
Please keep this in the vicinity of Elk Creek Ranch.
In addition, one of the kittens from the barn which I named Nutmeg will be going to the Pet Smart store in Brandywine Town Center for adoption through Forgotten Cats. He’s a gray with interesting markings, very cute and friendly finally. His sister is a orange or buff color and she’s twice his size and so pretty, and she’ll be going to the adoption center soon too. They are both already spayed/neutered, vaccinated, dewormed and defleaed and excellent with the litterbox and love to play. They are house pets, not barn cats. Their mamma will be spayed at the next clinic day and she does not use a litter box, LOL, so thank goodness for vinyl floors. She’s friendly so if someone would take her at a nice barn she’s be a great cat for you and so sweet, pretty tortie and I think her eyes are green.

A 36 race career running for Drug O’Neill and the Gill posse… she has to be tough as nails. It’s a shame that she missed being G-1 placed by 3/4 of a length in the Oak Leaf- may have been retired as a broodmare by now.
I watched a couple of replays of her (Black Magic Mama) races. Nice mover. Looks a little narrow-chested from what I could see; also looks like she carries her head a bit high … but that can probably be corrected. She’d be worth considering a claim, I would say.

This particular filly was DD’s big horse in his barn all of last year. To the best that I’ve been able to tell she’s sadly typical. I’ve never seen these people ever move an animal up in class or improve anything they’ve ever gotten their hands on. In better hands this filly could have been a champion.:yes:
That also goes for PNGI. Hate to see them involved in Maryland and Texas lately. I’ve no doubt they’ll ruin racing there too:cry: Individuals like this and organizations like this are what is killing the sport.
Yesterday was a sad day. I am sure that most of you are not familiar with a horse named Red Nickel. She died needlessly after a breakdown while training yesterday morning at Penn National, during which two riders were injured. I morn her passing. I knew this lovely chestnut girl after having rubbed her last winter for Tom Lingelfelder while trying to train my own at the same time, a situation that just didn’t work. I left Tom’s employ to spend my time training mine. I know manure happens, but this my friends was preventable. Last December I was sure this sweet girl was close to retirement. She had a knee and ankles and it was a struggle just to keep her comfortable. She was a long way from being sound and I was worried THEN that a break down wasn’t far off if she kept training. Her condition was no secret to the other grooms, to the trainer, to the vet. While she may have been short on soundness she was long on HEART. Even though she was sore, so very sore, she would run her heart out time and time again and come back lame. She was sweet and beautiful and willing and now she is dead, needlessly. And why was her career/torture prolonged??? It is not as if she was a high dollar stakes horse. She was a cheap nickel/$4,000 claimer. I truly hope that there is a special place in hell for trainers who run a horse they KNOW is unsound until their legs snap off and they die. A special place in hell for trainers who send riders out and with horses they KNOW are unsound to this degree. These trainers may ACT like they care so very much about their horses and their riders but in truth they don’t. They don’t care if these riders die or suffer injuries that affect their ability to earn a living or continue to ride or walk, or if it might hurt the riders’ families. And some of these trainers hold positions with our HBPA, who so loudly advocates retirement for those horses that are so unsound they cannot run any longer??? It makes me sick to my stomach. Please take a moment to think of Red Nickel and her needless death and to say a prayer for the riders injured yesterday. Business as usual…

Thanks for bringing this to our attention though I’m so sorry to hear this tragic news. It’s very disturbing to know that these trainers exist and nothing is done about it. It does sure seem so easily preventable but some of these trainers would have shipped her off to the auction or directly to slaughter. Running an injured horse is not the answer either. Kinder trainers might have used her for a brood mare but if she’s not fast, they don’t want her. I’ve seen some of the broodmares that were said to be fast with serious conformation flaws, down on her hocks. But she was a broodmare, passing on those flaws to her offspring. Breeders are so proud that they’ve bred 50 foals one season instead of breeding very selectively.
The entire animal industry needs policing, they won’t do it themselves. Darn, makes me so mad that the greedy breeders and trainers are so common.
…And did I mention that Red Nickel’s trainer was caught up in sending one of his staff out to scout out another horse to claim before Nickel was even room temperature??? His comment heard in the barn before she went out to breeze and die was “She’ll either make it through this today or she is out of here!!!” And a year plus of torture is a kinder fate that the auction or killers? None are kind and right but to prolong a horse’s suffering day in and day out for over a year??? The issue here is principles, ethics and RETIREMENT BEFORE catastrophic breakdown occurs. Especially if the trainer in question serves on the board of an HBPA who touts retirement for ex racers like a wearing a hair shirt.:mad:
