It’s up to the photographer to take acrion.
If a photo is used without their permission and they become aware of it many Pro photographers today will sue over this or at the least track you down and bill you. If you don’t pay then you’ll be speaking to a collection agency.
It’s also why some photographers require you to pay an up front fee beore they will take pictures of your horse at a show.
Or provide a cc number for a deposit before you can even look at their website.
Here’s a notice from the web site of a well known photographer.

<smile>…It happens all the time! And we do track them down and request appropriate credit be given. I noted that above in my post. Our articles are “our” profession. I noted that also. But I also note and stand by it, that you’ll get much better results and a much more positive outcome if you don’t start out with “I’m GONNA SUE!!!”. When we find someone has taken an article and posted it elsewhere, usually on their website as a source for information, we contact them and explain that the article is “copyright protected” and could they please give appropriate credit and links. 99.9% of the time, an immediate response is received, the appropriate changes are made and everyone is happy. I think most of the time, it’s a matter of an oversight. Getting in peoples’ faces and making accusations that they’re “stealing” when that was definitely not the original intent accomplishes very little but a lot of anxiety, bad ju ju and not nice business relations Why go there if you don’t need to?
Additionally, I think you will find that it wasn’t a pro’s photo that was taken. Not saying that makes it any more right, but I believe the OP’s original complaint was that absolutely no credit was given to her for breeding the foal and/or the photo. She wasn’t looking for payment, merely appropriate credit.
My point is that there is a better approach than by immediately making demands and threatening legal action. And as you can see, there was an explanation and subsequent resolution without things having to get ugly.
I can give you a prime example of just how sometimes everyone’s perceptions get skewed and sometimes overlooked. We had a well known professional photographer attend one of our courses a few years ago. After attending the course, she contacted us telling us how wonderful the courses were and how she felt that her vet could learn so much from our course notes. So, she copied them and gave him a set of the notes :O!! I “did” remind her that she just did what she considers one of the biggest complaints of pro photogs ;). Yeah…I’m gonna sue her <lol>. Not. It happens! Sometimes a gentle reminder is all that’s necessary and quite honestly, I think that is better. Granted, there are DEFINITELY people out there that make a habit of stealing things, making commitments they have no intention of paying for, but those people are usually found out and develop a reputation pretty darn quick. Heck with those people, I’ll even help you roast 'em :). I hold grudges. Big, fat, mean, nasty grudges. Just ask my ex <ROTFL>…
I would prefer a tactful, collaborative and mutually-beneficial approach to resolving an issue such as Kathy had suggested versus the “shoot first, ask questions later” approach any day. Unfortunately, I am certainly guilty of the latter and hope to continue learning something new every day and become a better person as such. Thank you, Kathy!

The Hanoverian filly For Kicks, now two, is by For Play out of Kleopatra R who was put on this earth by Edgar Schutte with the help of his stallion Kalypso and an A line Hanoverian mare. I took the photo because I just couldn’t believe how well that very young filly could balance standing up at the edge of a narrow island of green in a sea of black. She’s still beautiful and balanced to this very day! LOL!

Dacia, I’ve been looking very hard at For Play for 2 mares by Aristos B and out of a Consul mare this year. Both are LAAAAAARRRGE girls (17+ h) with very substantial bone, lovely big movers and easy temperaments. One can be a tad hot under saddle, but not in a bad way. She was a very successful show jumper and the quieter mare excelled in the hunters. They are full sisters and both have a very stylish jump and way of going. It looks to me as if For Play might refine them a bit and “tighten up the package”. Did I mention that they’re huge? Babies are welcome to choose their discipline, preferably hunters or jumpers, but we churn out the occasional dressage mount as well.
One of the girls, the bigger quieter one, is a plain bay, no white, and maybe has a bit of a course head. Her first foal, now almost a yearling, a filly by Freedom Z is ginormous and not as lady like in appearance as she could be, so I’d like to find Mama a fellow that might control the size and lighten up the foal just a touch. The coarser mare’s full sister is just darling and as feminine as can be even with all her size. Isn’t breeding a funny thing? The prettier girl (don’t tell her sister I said that) will deliver her first foal in early April.
Anyway, freedom of movement and jumping form are very important to me and For Play seems to have both. He also seems to be very gentlemanly and if we can package the talent of these two girls along with the talent and smaller package of For Play along with a temperament suitable for an amateur I will consider the breeding a success! What do you think?

I think one of the rare things about “Zaia” the talk of the hour is that she is a buckskin. A lot of people don’t realize that liver chestnuts produce the rainbow of colors I hope I get another black one this year by For Play!
Another of For Play’s Filly’s who is also in the ad the thread is about is For Kicks, She is wonderful and dianehalpin does an amazing job with her breeding program.
As for everyone else involved in this thread, I am very appreciative to all of the compliments you have for our stallion For Play. He truly is one of a kind and I am so blessed to have such an amazing friend of a horse that is so talented.
The Mare owner who had expressed her concern originally about the photos is right in her anger about her feeling of us not getting permission to use her photo and we would have never wanted to offend anyone but being the nature of the situation I mentioned above with how we received the photos in an inbox from an invitation to send in photos we never thought to call and double check that they were truly sent from the owner. That is my fault I made the assumption that it was okay. The Mare owner does have photos of For Play on her sight and yes she did ask permission 3 years ago.

I always send stallion owners foal pics at different stages. I am so disappointed when I don’t find them posted on stallion site. I never thought about it the other way around. A good learning thread.
Also, to JackieBlue, I have a large boned, tall mare that is still feminine but want to be careful who I breed to so that it does not push baby to the course side. She has industrial strength bone, hocks, etc. Amazing movement and jumper form. I see For Play often and know I cannot go wrong with the cross. He is masculine but sexy as all get out and that boy’s movement and form will take your breath away. Here is my girl that I am positive will cross well with him and share your same mare concerns:

What a class act the stallion owner is! Some of you need to have a better way to spend your free time. I got annoyed one time with a picture of a horse I owned being used. That was because they went back home and put him on their website as being sold by the them for lots of money. Had they actually gotten me that money, then hey work away. But since I sold horse myself to someone over here it was just silly. However, I didn’t go all defcon 4 on their arses. I called to find out what was up, asked them to kindly remove photo, and they did.
Had a stallion owner used a picture of one of my foals with a picture I took, I’m not going to freak out. I sent a little clip of one of my foals enjoying the snow we got this year and SO asked me if it was ok to put on her Facebook. Yeah, no problem. And if she hadn’t asked and I was looking through my Facebook news feed and saw Lila I would have been delighted.
Really comparing illegal music downloads to this situation is a bit silly. We all know there is a big difference, at least we should.
