If this whole Stormy thing does nothing else, I hope it puts a bullet in bullshit NDA practices. As someone upthread said, lawyer letters are cheap, and in my ANAL anecdotal experience hardly anyone is going to sink big money into enforcing one on something nebulous and subjective as quality of a horse. At some point, the negative PR garnered from bullying someone with an NDA violation outweighs whatever reputational fallout they hoped to avoid in the first place.

A non disclosure agreement is agreed to by the parties that signed it. It does not apply to anybody who didn’t agree to the terms and sign it. Much less somebody completely uninvolved, even unaware of whatever transaction inspired the NDA.

Thats nuts. Their threats remind me of the scammer phone calls and e mails trying to collect fake bills or taxes. You are free to express an online opinion on any business, even on transactions you were not a part of.

These people deserve a lawyer letter. Might not even cost you much or anything at all to stop this rather outrageous harassment of you and your freedom of speech as a non signer of a non agreed to NDA.

I haven’t received a letter from an attorney, just several emails to me and also one to my friend stating they have “proof” I was acting as my friend’s agent in various email correspondences with them. Kind of funny, you’d think I’d remember those emails or be able to find them if I sent them and you’d think I’d remember if I was acting as someone’s ‘agent’, lol. They have given me till today, Wednesday, to take down all reviews ‘or else’ the husband will have to call the attorney. We shall see. I am not interested in litigation. Anyone can sue anyone for anything. It doesn’t mean they will win but it can cost money. I just think these folks need to be exposed for this kind of action toward the public, and yes, my freedom of speech to post whatever I like. I did not sign anything with them. I have read this exact same ‘story’ on other sites like ripoffreport.com where people purchased very expensive horses from this place and the horse was not as represented. I wonder how many people are out there who backed down and removed the reviews? I don’t want to hassle with this but I also want to see the right thing done for my friend. She has no horse now and is out the $22k she paid. They said they didn’t have a suitable exchange horse and didn’t know how long it would take them to find her a replacement horse! Apparently, they make no provision in their contract to replace the horse in a reasonable time frame. Could be 2 months, could be a year.

findeight you called it, outrageous. I have never seen a horse sales contract with a NDA in it. That’s the threat of a lawsuit before anything ever goes wrong!!! Brilliant business model, don’t you think, silence the opposition before they even get the horse.

Then why don’t you have a replacement horse for my older friend who purchased a horse from you that is strong and athletic and she needs a quiet, safe horse?
