Is this because jails are under local (city or county) control and prisons are run by the state? It does seem backwards and unjust that someone awaiting trial would be denied books.

On the other hand, “socialization” in prison is probably more dangerous than in jail.

No, prisons can be federal or state and vary widely in their arrangements. About 75% of detainees in jail are persons awaiting trial.

Jails are generally designed for more short term stays, but the Morris County Correctional Facility is fairly large and has its own facilities for food preparation, exercise, and a medical facility.

Morris County Correctional Facility has not given the vaccine as of yet.
Prisons are set up to house longterm, jails are not. The medical and dental care in the jails is seriously lacking.There is no outside yard, so none of the inmates have been outside since they have been in, some of them going on 5 years! There is no opportunity to take any classes to get GEDs or College credits. It is just a holding pen set up to keep people 6 months, not years. It is unfair that people that are still “innocent until proven guilty” are treated way worse than those that have been found guilty, The system is set up to break people so that they will take a deal just to get out of the jail.

I know that prisons can be federal or state, but they’re not local (city or county). “Morris County Correctional Facility” sounds like it’s run by the county. If jails are locally run, there could be a lot of variation between different jails.

If he is sentenced to a prison term, he will receive credit for time served.
Wasn’t it his lawyer who asked for continuances and delays last spring?
I agree it would be unnecessarily cruel to deny inmates access to books. However saying there is no access to college classes is not saying there is no access to books. MB hardly needs a GED.

California prioritized prison and jail inmates, and especially staff. It is surprising to me that a liberal state like NJ would not have done the same.

I am not specifically referring to MB. There are others that are in jails all over the country that are treated the same way. I did not say anything about books in my reply.
It is not unusual to ask for continuances and delays when the prosecution is dragging their feet, to the point of being reprimanded by the judge, in sharing discovery! Oh, and if I remember correctly something called COVID happened and shut the courts down last March.

It is particularly shocking that they are not allowed any outside time at all, particularly with on line hearings, etc. This coupled with no visitors seems especially cruel to me…as you said, innocent until proven guilty.

Thankfully COVID-19 has given Bilinski plenty of time to build his defense since the courts have been shut down.

NJ did. However, vaccine delivery requires specialized refrigeration, which may only be possible via a mobile unit if the in-house medical facilities do not have those type of freezers.

Morris County Correctional Facility is in fact a county jail. It is not a federal or state level corrections center. It does, however, have many more facilities than you might expect for a jail including an addiction recovery wing.

There is a case to be made that those being held prior to trial (usually about 75% of those in county jails) are innocent and therefore are being unlawfully punished for a crime they have not been convicted of. I don’t think any cases on this matter have reached resolution at this time, in New Jersey or elsewhere.

Are the new detention hearings that NJ Supreme court ruled on offered to all inmates or does it depend on the charges? Also, if a plea offer is made and an inmate declines it, are they still eligible for the new pretrial detention hearing?

My point was that Barisone and lawyer have decisions to make as to whether to ask for continuances, and can take into consideration the benefit to their defense vs more time in jail prior to trial.
I looked up the NJ vaccine priority scheme, and residents and staff of congregate settings were 1A. Congregate settings explicitly includes “county jails”.

Do you have specific information that Morris County Correctional Facility was not included in the vaccination program as 1A? Neither inmates nor staff? Surely vaccination of the staff of correctional
facilities is very high priority, and if you go in to vaccinate the staff, you vaccinate the inmates as well, if for no other reason than to further protect the staff.

MCCF makes the “programs” they offer sound great, but it is all smoke and mirrors. No church, or place of worship, a priest comes in maybe every 2-3 months for a quick visit. The “exercise facility” is a 20x30 room with a pull up bar and a basketball hoop. A dentist comes in every few weeks with his tools in a tool box. If an inmate has a problem with a tooth, they just pull it, no dental work is offered.
No fresh fruit or vegetables are given nor can they purchase any from the commissary. It is quite frankly unhealthy and inhumane.

Inmates can have books sent to them through approved suppliers.

Do the inmates have any opportunity to connect with friends and family “Zoom” style? It has to be very hard for them not to see their loved ones in person.

As “congregate settings”, county jails were in 1A along side assisted living facilities. Assisted living facilities have gotten the vaccine by someone like CVS coming in and vaccinating people )residents and staff). The vaccine needs to be thawed for administration but remains viable for 3 or 4 or 6 hours, so the vaccine needs special refrigerators for storage, but not for administration in congregate settings.

The rationale for locking up some people awaiting trial is not for punishment, but because they are considered a risk to themselves or others if they were to be released.

Sort of like lots of us have been in look down for months is not for punishment, but because unfettered socializing is deemed risky due to Covid.

There are video chats possible certain days and times. They are quite costly for the inmates and their families though. Just another way for the County to profit off of people that are already having hardships!

That is horrible for people and their families that may not have the resources to pay the fees for these services.

Well, not that citing case law will make much of a difference to your opinion, but a prisoner’s subjective dissatisfaction with his medical care does not in itself indicate deliberate indifference for an 8th Amendment violation claim, Andrews v. Camden County, [95 F.Supp.2d 217, 228]. There is no presumption that inmates are entitled to unqualified access to health care (Hudson v. McMillian, [503 U.S. 1, 9] (1992)).

I haven’t been to MCCF in several years and I have no idea what their current Covid protocols involve, however, I have been told that all inmates have access to zoom meetings for communications. It has long been the case that phone calls to friends/family are not free, only the legally required calls with your attorney.

In general, no, I don’t think that you pull stuff out of thin air, although I’m skeptical of your assertion that the inmates of the MCCF have not yet been offered the vaccine, given that county jails are listed in the 1A priority category in NJ.

You often seem to have specific information on MB which has suggested to me that you are more of an insider than most posters.
