Federal Fraud Case

This just in from the VHSA…

TO: Associate Show Managers

DATE: September 19, 2007

In compliance with the ruling handed down by the United States Equestrian Federation (USEF) Hearings Committee meeting held on November 8, 2006, Joshua Cardine and Kenneth “Keg” Berlin; both of Newport News, Virginia, are ineligible for membership in the VHSA as Regular or Associate Program Members. Also pursuant to the USEF ruling, they are banned from any VHSA competition as spectators, participants or in any other capacity. Horses owned completely, in part, or in any form of partnership, or leased by Mr. Cardine or Mr. Berlin are also banned from showing. This ruling shall stand for a minimum of five years at which time the aforementioned individuals may apply to be removed from the USEF banned list.

Wow – they must be busy over at VHSA. This took what – a year?

I guess better late than never…

Okay!

At least it is a FIVE year ban at the minimum!!!

Banned from being

“spectators, participants or in any other capacity. Horses owned completely, in part, or in any form of partnership, or leased by Mr. Cardine or Mr. Berlin are also banned from showing.”

Wow! The way I read this, they can’t even be on show grounds during a horse show… is this what it’s saying??

If it means these men can’t abuse anyone that’s great!

Yippee! It’s about time that the Federation and the other Associations decided that convicted felons do not belong in our sport where they can con more people out of their money and horses. If we truly believe in the horses and the children we don’t need thieves, horse killers or pedophiles in our shows. We have enough of them that have not been convicted

Just letting everyone know I met up with my new boyfriend at the BBQ Country truck stop this evening… wow… he even surprised me with a bunch of “2 buck chuck” wine from trader joes!!!

What a sweetie… maybe he brushed up on those skills while in those pretty orange jumpsuits…

BTW, Gracie wants to borrow his jumpsuit for holloween!

I couldn’t agree more, Snowbird!!!

Oh LBB…you are a bad girl!!

RNB ROCKS!!!

How about some updates??

Seems RNB donned her flame suit, tin hat and a pair of killer high heels and went to Richmond!!

:lol::lol: That I did TWF!!! And boy did that flame suit come in handy. I went to Richmond, VA in hopes of getting a bill heard before the General Assembly dealing with fraudulant horse deals. Here’s the link to the thread in Off Course… http://www.chronicleforums.com/Forum/showthread.php?t=131038

How are the legislative measures going in VA?

If you were heard by the Legislature any result yet?

I find it very sad that as individual citizens there are just a few like you wiling to take on the real battles. Winning horse of the year and some blue rayon doesn’t even come close to what you have accomplished.

Horsemen have lost their prespective and are not seeing the next fence. That has allowed those who are dishonest to gain a foothold in a sport that was a “Family Recreational Activity”. We are losing to those who prize money more than they prize the horses who make it all possible.

I went to the Convention in 2006 with a proposed rule that anyone who has been “CONVICTED” of a felony involving the theft of horses and the lack of compensation to the real owners, or those who have been “CONVICTED” in Horse Frauds, or those who are “CONVICTED” pedophiles should automatically be suspended from activity in the Federation and any Federation licensed show. They would not hear the discussion, and it was left up to John Long our “CEO” to decide.

We know the criminals can pursue the “Unrecognized” circuits but it is a start to set standards. RNB and TWF you both deserve the “Horsemen of the Year Awards” for your hard work and sacrifices. If this has to be done state by state and if the Federation won’t help then how many of you are willing to sponsor similar bills in your state?

The “Equine Activity Laws” started by Colorado have saved us all sleepless nights from frivolous law suits. It’s time to take the next step.

Riding s horse is healthy for children and those who do not are sitting around becoming obese and unhealthy. Yet, the current trend from Washingto under the excuse of “Clean Water” submits statistics that are flawed showing horses as contaminators of the water. If it hasn’t come to your state yet it will be soon. Horse manure doesn’t pollute the water when compared to chemical fertilizers, insecticides, germicides and other human waste. . While horses may not drink water from brooks and ponds all the wil “protected” wild life including the Canada Geese are protected.

It’s time for more than reports of what someone has accomplished FOR you and to become active and participate in the struggle. I am sure if all the horse owners in Virginia showed up in Richmond that law proposed by RNB would already have been passed unanmously by the Legislature.

It’s not enough to have a “Horse Day” and to honor horses as an American Heritage with lip service. In New Jersey the state animal is the “horse” and that didn’t stop the Olympic Team from moving out to another state. That didn’t stop New Jersey from forming the Hghlands Council which has stolen the equity and the property rights from horse farms. It hasn’t stopped them from saying that a declared waterway " a brrok" on your farm must be fenced in with 300 feet on either side to keep the horse out.

The real gift of horseback riding is to teach you to look where you’re going not down at where you are or back to see where you’ve been. Wake up horsemen! This is not a spectator sport.

Snowbird…thank you for the nice comments…much appreciated!! I too wish more folks would take on the battles that continue to plague the equine industry, though I completely understand many of the reasons they do not. It does take a lot of time, persistence, thick-skin…just to name a few. But for the health of our sport is has to be done…and continuously.

Personally, I have nothing to gain at this point but I do want to help protect the future generation of riders. I too, was disappointed the rule change proposals were not passed. For the life of me I can not understand why an organization would allow such individuals to continue to be members. It gives our sport a ‘black-eye’ in my opinion. However, the new rule proposal that was presented in 2007 was not totally dismissed…so I am hopefully that something will be passed next year. I have offered Ned Bonnie and the legal folks within the USEF my support/help in anyway they might feel appropriate.

As far as my bill here in VA (SB172), it was tabled until the next session in 2009. As many of you know a bill goes from committee to committee in the General Assembly. Mine started with the Agriculture Committee and then proceeded over to the Courts Committee. Because there was conflicting support from the horse community, the Courts realized this was something that needed to be addressed and is giving the equine industry one year to work on it. The bill had a lot of supporters (most of whom I had never met) but there was a group who chose not to support and another group who wished to remain neutral. For those who chose not to support, they will have a hard time explaining WHY. The Senators want to know why having a sales contract and full disclosure is a bad thing when spending thousands of dollars buying a horse.

I agree Snowbird, if all the average horse owners showed up the bill would have more than likely passed. Sadly many of the folks who supposedly represent horse folks in VA are in the business of selling horses. I was surprised how few regular horse owners were lobbying the halls of the General Assembly…by regular horse owners I mean those of us who truly support the industry, the folks who write the checks.

The equine industry here is VA can not change the wording of my bill…only I can do so. They can discuss it amongst themselves, discuss it with me and ask that I change something, but the bottom line is my bill can go back before the General Assembly next year exactly as written. My Senator has already stated that he has no intention of withdrawing this bill and it will be back in 2009.

So COTHers…I’ll keep my boxing gloves on for at least another year and will keep everyone updated on all the craziness I am sure to encounter!

I know I was very lonely and it took me eight years

The New Jersey Equine Activity Law took me eight years to get passed and although under the banner of the New Jersey Horse Council no one showed up at the meetings. Proudly, so far as I know since it was passed not one lawyer has collected a dime from a horseman for liability from an accident.

I would hope that everyone on this Board will coordinate their activities to protect sonsumers and sellers in all horse selling deals. The way it is going these days if we don’t get together the horse world will continue to shrink

I’m old and my children are grown but I think those little obese coach potatoes will multiply unless we get our act in gear as will the horse family farm. Most people solve a problem by not participating in the sport and if the family farm becomes extinct so will this sport.

We know the criminals can pursue the “Unrecognized” circuits but it is a start to set standards.

This kind of thing might draw a lot of people back to the rated shows.

For the life of me I can not understand why an organization would allow such individuals to continue to be members.

Over beers recently some friends and I came to the conclusion that the horse industry, as it exists, is primarily a way to take money away from rich people. We had a hung jury on whether victims are seleted for their naiviete or whether all the head injuries horse people tend to suffer render them unable to ask for a receipt.

Good for you RNB, if the industry won’t regulate itself then the state has to step in.

Well you could be right

That may be the cause but on the other hand they don’t just scam the rich folks who can afford the loss. Although look at the death of Helem=n Brach and our friendly horse trader Joe Plemmons who confessed on National TV and is still welcome at WEF.

I agree with RNB we have responsibility to the children just starting and the horses that trust us all. I cannot find an excuse for a “CONVICTED” Felon. I’m not talking about rumors, gossip or innuendo which is open to a legal challenge. I understand the concerns of the USEF for Law Suits but a “Convicted” felon has no defense.

Join the party guys you’ll be surprised how much bettr it can be in this sport and yes! That’s how the AHSA started to win the battle against unscrupulous cheaters.

OH Boy

Come on Guys , here we go again. I mean this is really getting old. Let this Thread just die. will ya? Those guys have done their time. They have paid their dues. and here we are again. Right before Show Season this has to come up. I am so glad the legistation has more important things to do than worry about " some poor pony mom". Let this sleeping dog just sleep.
Enough already . Do you not have another topic you could discuss on this forum. OR are you that bitter and bored.

yeah - and let’s not talk about child molesters or sexual predators or anything unpleasant huh Equinoxfox 'cause we don’t want to think unpleasant thoughts

Equinoxfox as long as it’s not your kid or your pony right?

How sad for you Equinoxfox do you really think what’s most important is who won the most recent of blue rayon. I know how it is unless it’s you in the “zone”. I’m always astonished by the apathy until the issue comes down their driveway.

Clean paint on rotten wood isn’t going to last very long. A false front is transitory without any substance. These felons are like the rotted wood you can think all is good driving by; when it’s really rotten underneath.

Hurray for standing up and making the effort to stop dishonest and fraudulent activity! It is a lot of work and many can’t be bothered, figure it’s not worth the effort, feel that one person can’t make a difference.

Keep working, it is about time we ,as members of society, start saying ‘hey, what a minute - that’s wrong - and we’re not putting up with it’. :D:D

Get over it . Let it go and move on. That is the way life is. You win some and you loose some. Sorry about your luck.
