Federal Fraud Case

May I ask if you have read the bill? And if so, what do you oppose?

The annual ā€œget togetherā€ for the Federal Fraud Case is at Upperville this year. If you have been following this thread…please plan to find us there June 5-6-7 as we are planning to get there to watch the show together.

ANy body have the official last day fo the USEF suspension for both the felons in this case? Joshua Cardine and Keg Berlin?

It appears the ban for Josh is 5 years after Nov 2006??

It says he got 18 mos in prison and his probation forbid him to work in the equestrian industry. But this is an old case and he may have satisfied his probation by now.

here is another link offered by Equine Legal Solutions discussing the Cardine/Berlin case and one other, and the need for honesty and written commission agreements. Of course, no written agreement will protect you when dealing with someone who is basically dishonest.

ps/ based on the dates given in the Cardine probation modification ruling, he probably came off of probation sometime in 2008 making him free to work once again in the equestrian industry.

My question was specific to the USEF. Following other threads about USEF suspensions…

Date of Search: 5/17/2009
Red = Suspended from the privilege of taking any part whatsoever in any Recognized Competition, not allowed on competition

Both Keg Berlin and Josh Cardine and a number of horses connected to either are listed as suspended in RED as of 11/08/2006,. There appears to be no end date to the suspension.

It appears the USEF considers this suspension a current/ongoing suspension.

In case anyone is wondering, both men are still active in the regional horse stuff and have been since things blew over, and will more than likely be at Upperville doing their respective business. Have fun.

They are both still USEF suspended so I doubt they will be at Upperville. If they are then the show will be having a USEF problem for allowing them on the show grounds.

Did you mean that you’ve seen them at USEF rated shows? If so I’m sure you reported it.

Are they both still in good health? I haven’t seen them in years, and I was under the impression that one of them was quite ill.

I don’t hang out at H/J shows but I just know for a fact that both of the individuals in question have been all over the place at all the usual hotspots here in VA and elsewhere and it’s public record too. Ken (Keg) lets his wife or sister (not sure which she is exactly) Helena stand in the spotlight with his horses and she’s made a name for herself in his place while Josh just blatantly walks around doing his thing because nobody knows him from anyone else and what happened hasn’t affected him much. Think I’m mistaken? Josh even put in an appearance in the ring at Upperville last year handling a filly for an owner in his area and he’s all over the place as a breeder, handler, trainer, and owner, so it’s pretty safe to say he doesn’t have any qualms about putting himself out there now that time has passed and nobody knows who he is. Both gentlemen are breeding/buying/selling/running around just as they were before only a bit more cautiously perhaps. The wonderful thing about the banishment rules are that they only work if applied and they can only be applied if people actually know who is in front of them. Management doesn’t check the suspension lists and you wouldn’t be able to pick either one of them out in a crowd unless you already knew what they looked like.

I’ll PM you the information but it makes less sense to me the more I look at it and I’ll explain why.

They have been seen several times at Culpeper in 2009… during the HITS horse show.

Upperville does not list him as a handler or owner. Who did he act as handler for?
Helena is listed as an owner but not a problem, she isn’t suspended.
USEF rules only control what happens at a show so his being a breeder, etc is a non event.
Because he is suspended he can not participate as an owner or handler at a USEF show. The show doesn’t even have to ā€˜recognize’ him. USEF picks it up from the results file. That’s how they fine shows for allowing suspended persons to participate.
There is nothing to prevent horses he owns from being listed in another person’s name on USEF records. All they need is a sales document.

But if he is just at a show as a spectator then the only way USEF will know is if someone reports it.
So Lex, if you have all this first hand air tight info then why haven’t you reported it?

You are correct on all counts. However, I do not believe Bonnie said ā€œsheā€ saw them.

So Helena Berlin has been showing locally in and around Williamsburg and Smithfield. She has been showing a horse called Love Me True and not sure who the trainer is. Its a guy with a beard who sports all western clothes. They come with an older woman and a younger woman with long black hair. How nuts is that that they just show up and show and act like its all good?? They told me they are from Suffolk. And the kids name is always announced as Helena Berlin. Really can’t the local guys realize who she is and who she is affiliated with??? Totally nuts
