Since buyer called seller and told her that his earlier stipulation of PPE had been met, and that he did intend to buy the horse, and said he was mailing a cashier’s check for an amount that he and seller agreed on…

Would that legally bind seller? If donkeyman came with his trailer, or if anyone else offered to buy the horse out from under Thing 1/Thing 2 and their buyer, would seller be able to accept another offer?

My theory has always been “the first person to hand me CASH gets a horse.” So, I would say no deposit, no check, no horse…

BUT… sinces he’s already had the horse vetted etc… I don’t know. What do the other COTHers think?

So anyone else think that the next thing that will happen is that the buyer will want to send a cashiers check for 5000 more than the agreed upon price. Seller should cash the check and send him back the extra $5K right away…
