Yes, she would. It’s called “fraud”, if indeed Thing 1 and Thing 2 made commission without disclosure to both buyer and seller.

In fact, if it’s over a certain amount, it’s felony fraud, and both Thing 1 and Thing 2 would end up in jail. It’s happening a lot nowadays; trainers
“skimming” or “double dipping” and being caught, and being imprisoned.

Years ago I had a student who had outgrown her large pony, we sent the pony to a well known pony sale barn in Middleburg. Very quickly we figured out that sale barn person was not to be trusted but that is a whole other story, so the seller person, shall we call her AJ, sold my clients pony after giving her a song and dance about how hard she was to sell… clients drastically lowered the price, against my advice mind you. Said pony got sold. All well and good until clients took a trip to florida and ran into their ex-pony and new family. New owners say “best $20,000 we ever spent” of course my clients went :eek: as they did not recieve anywhere near that amount. Lawyers called in, AJ had to pay the difference to my clients in 10 nice monthly installments… :lol:

WOW I thought we would never see the end of this one. I have been following it all along. I would love to know the name of the trainer in FL as I may be moving that way in a month. Would like to stay far away from her.

I strongly suspect that the trainer (maybe both) got wind of this thread. :winkgrin: You can’t have over 100,000 views on this very vocal thread without someone breaking the news to the jerk-around trainer that “Hey! They’re posting about you on the COTH BB about jerking around some seller, and they have photos of your kid at a show riding the horse!”

I can imagine them logging on, seeing this, and figuring they better put a speedy end to the story before they got outted – which I would estimate was only several pages away from happening. It’s a small world, and everyone knows just about everyone else in the Florida horse venue. Already too many clues, they were being watched, and easy enough for that info to <ahem> slip into our collective public hands for the whole world to see.

Wise decision.

I think the COTH community can applaud itself. Otherwise the seller would, without a doubt, still be SOL in being strung along. :yes: She owes us and her buddy epona for bringing this into the spotlight.

Now we have Donkeyman and all other Florida cothers follow T and his new owner to their shows and report their progress to us! We can’t not follow this horse forever!:eek:

I just spent entire afternoon/evening yesterday catching up on this saga. I know the drama is over (hopefully) but:

Question 1: If my memory serves me correctly, wasn’t the seller into Reigning/Western Pleasure? Then I heard something about Eventing… Does seller do multiple disciplines? I could have made that up and have no clue how far back this info is in the posts. Please correct me if I am wrong.

Question 2: Regarding “bogus” x-rays and need for “Pre x-rays before sending horse to potential buyer”. If seller did have these “before x-rays”, how does buyer know they are legit? Is there a way to truly make x-rays legit? Couldn’t potential buyer come back and say “How do we know these are actually x-rays of said horse?”

Well, if this is actually over then something needs to be done, asap, about that tv writers strike.

So now that it’s over, what have we learned from this? If you do let a horse out on trial, within easy driving distance to allow for quick pickup if it isn’t going well, what things should be in the trial contract? What is a reasonable amount of time for the horse to be gone? What if there are a few people at the barn who are looking to try the horse, who signs the contract? I think in some cases, a trial is a good thing, some horses take some getting used to, and some people like to see the horse in their home barn. But, obviously, a detailed contract is necessary, I’m just looking to see what you all would include. Although this was entertaining, in a sad way, I hope to not read a similar thread about sellers getting hosed.

Wow-this actually happened to my parents in the 80’s. They bought my sister and I a super hunter pony my father fell in love with at a big hunter show for x $'s through our trainer (mistake #647). A few years later my sister and I ran into the pony’s previous owner’s trainer and had a long talk about that sale.
Apparently they thought we were horrible and only paid about 1/2 of what they asked. We thought they were horrible because we had been told they wouldn’t budge on the sale price and were being extremely difficult. My parents are still less than amused knowing the truth now and are still kicking themselves for not being in direct contact with the sellers.

yes folks the trainer that made the fraudulent profit on that pony is still in business. He has a bad rep in the area for a gambit of reasons but there is always a new group of kids and well-meaning parents easily snowed by the facility’s appearance.

Back to pony: Thankfully, they had followed her/us in the show circuit and knew she was loved and well cared for. Original trainer even came for a happy reunion after this chat and was able to report back to the owner/breeder that she was still very happy and still beautifully trained (and of course at a new and more laid-back facility).

So many lessons in this big used car lot we call horse sales…going to miss this thread. Can’t wait for the spin-offs though!

Anyone else vote for the creation of COTH BB sales agreement doc or tips?

I had no idea about fake xrays and am stunned Iron Horse saw their horse being resold with “clean xrays”

Would the vet be liable in any way for something like this? I saw someone posted that the horse’s name should be on the xrays. Is that by region or everywhere?

i am betting thing 1 and 2 made ahuge commission otherwise why do it and stick with umless you were getting something out of it

at least the horse has a decent home and well fed and happy and looked after thats the main thing

I “heard” comission PLUS Finders Fee - not to mention training fees, show expenses etc etc etc triple dippin. Had to get it done FAST! And yes, they have been reading up. :cool:
