Getting Papers On A OTTB

I purchased a OTTB and have a bill of sale. The problem is the seller didn’t have her papers. I know the owners that were last issued a copy of her papers but they have since disappeared from the racing industry. My question is will they issue a duplicate copy of Foal Registration if the person I purchased her from isn’t the last person who had her papers?

Pretty sure you will need to ask the last owner of record to contact the JC and apply for a duplicate.

The “owner of record” would be the person who owned and RACED the horse in their name. Because there would be a verifiable “record” of their ownership. Which is kept by the Racing Secretary at the track/s the horse raced and it would be a matter of public record in the horse’s PPs. Which the Jockey Club can verify.

But even with this type of documentation it still might be tricky. Change of ownership can be recorded with the JC but it is not required and a lot of people don’t bother. Which the JC may point out and deny a duplicate.

It is easy for the breeder/owner of record to obtain a duplicate. They can fill out the application form and submit an notarized affidavit stating what happened to the papers. You can’t just say lost/destroyed , not sure how/where. You have to say how they were lost, like “file thrown out by accident”, destroyed, "my dog ate them, house burned down. etc.

That’s my understanding. I have had to purchase several duplicate because the forking trainers don’t bother to pick up the papers from the Racing Secretary and or return the papers when our horses are retired. But I was the owner/breeder of record so it was easy.

I don’t pay my last training bill any more until the trainer/s send back the papers AND my silks. For some reason they think it is no big deal. Papers cost $150 to replace and silks $200-500. God forbid I short them $300-600.

So, that’s the long of it. In short I doubt very much you will be able to obtain a duplicate. Why do you want/need them?

I assume you have verified that the tattoo matches the horse you believe it is?
