Help, Buyer Threats

I have tried to google her name, The horse, and any combination of the two. Since she never contacted me on fb I cant find any luck of her on there. No sign of the horse being resold that I can find.

I agree with Clanter. Not that I disagree with the rest of you - but because I have driven in Mexico … in an RV filled with Boy Scouts! The buyer sounds like someone that is used to getting her way by yelling and threatening. I’ve hired attorneys in matters I could have handled myself but I simply didn’t want to deal with an idiot. It pollutes your airspace.

In the F150 v F350 example posted: (full disclosure: I drive a F150)… it’s fraud and a few other things. You complicated it by throwing in the title stating F-150. That raises the buyer doing his due diligence. I’m not sure how a judge would rule. I would think the outright fraud would trump. The judge could award a full refund or the difference in value between the two models.

In my own personal experience, the remorse factor that surfaced after a sale or lease to buy was the buyer realizing they weren’t ready for the horse. That could be the case here. I think knee surgery was mentioned. That recovery takes longer than many people expect. Or, the horse has been injured.

I like the recommendation to do some research on the buyer. It’s amazing what you can discover when you dig back into page 20 or so off google. I hope she doesn’t have a common name. Her behavior indicates to me that she likely always deals with people this way. good luck… don’t let this person pollute your day…

Not trying to imply that you don’t know how to google, so if you’ve already done this disregard…

Put her name in quotations in the google search box and then add the city she lives in. For example “Jane Doe” New York.
If she has any kind of professional career, she may have a LinkedIn account. Those are handy for sniffing people out.

Also, you can check your states court records for any previous litigation records - criminal and civil. It looks like the Idaho link is here. -

just a few tips for internet searching if you weren’t already familiar. Anytime I’m in a contentious situation, I prefer to know all I can about the adversary…and the internet leaves a looong paper trail.

She may have you blocked on Facebook anticipating you would be doing this. Maybe ask a friend to search, also by maiden name if you can find it.

Stick with this, no matter the temptation to respond to her…

She’s trying to scare you into an immediate response. Let your lawyer answer her. She’ll quickly figure out that you’re not scared by her “I’ve got more money than you” tactics. That doesn’t mean she will stop trying, but it’ll take some of the wind out of her sails.

I know it’s tough to worry about what might be happening to the horse - but if what she wants is to return the horse, she won’t get rid of him. He’s likely already a bit of a mess, so going to take some time to recover. That’s always going to be true, so letting your lawyer work out a suitable solution is the way to go right now.

ETA: regarding the Facebook search - another thing people do these days is first and middle name only - with a google search including their name and city they currently live in it is usually possible to figure out the middle name or at least an initial.

The website duckduckgo.com is a good search engine. Unlike google, it does not try to guess what you are looking for. That may yield some results.

My friend was threatened with arrest if she were to visit the horse she was scammed out of…
i did also recommend she take legal action.

You mean threatened with arrest for trespassing? :lol::lol: your legal advice (as a trained psychologist?) should have been don’t trespass.

OP: You can also try zabasearch.com. You enter her name and state. It may give you other names she has used. It will give you her address and possibly associates, relatives. It will also give you past addresses. Those are just clues to expand your search. You can try checkmate.com. Unless they’re doing a freebie they charge. They are so-so. Your attorney may have resources she can use as well.

And, you may have to go back far into google pages. I was researching someone and found this group. I’d never heard of you guys before.

familytreenow . com also has way too much information on people. I opted out (not easy to find on their site either), but for anyone listed, you put first name, last name, state location, and you get a list of people with that name, you see everyone related to them, possible associates, but addresses they’ve used too.

I’ve located people using that before, and you may have to go through quite a few possible people, and look at addresses to confirm if it’s the right person, but you can find people who moved years ago, and find their contact information.

Monday update.

sounds like it is gunna be either court or buy back (full price no expecptions). Turns out her family member Is herlawyer, so something tells me she has done this alot. Claims if it goes to court they will also want money spent on vetting,training, and medical costs because buyer got hurt working with horse.

this is down right ridiculous, gunna weigh options and go from there and call lawyer.

OF COURSE her lawyer is a family member. Must be same breed of crazy because no self respecting attorney would take this case.

Hogwash. Tough choice though, because fighting is often harder than giving in.

Go to court. Remember, the jurisdiction is the county where you live, not her…so if she is out of the area, the burden is on her and her attorney to show up in your county. She is a nutbag…bring it on.

Did she pay with a personal check? If so ask your bank for a copy of it, A money order makes it harder but I you can still pin down the location.

Yes, this was an email response from the certified letter sent last week. He forwarded it to me, and is currently dealing with it. We are currently planning to go to court, just a matter of how we want to do it right now. Have an in person meeting with lawyer later this week.

sounds like borderline racketeering, what does your attorney say?

might want to tack this family down to see just what they have done in the past, prior legation and what they went after

As a side note one of the reasons when we were active in the horse industry our farm was a C Corp which we could bankrupt if needed

Yikes, this one is a little bit more crazy than usual.

Good luck getting it all sorted out. These things tend to drag out and hopfully she’ll lose interest when she realises she won’t get her money back quick smart. I went through something similar except it was after 2 1/2 years the person came back and wanted a refund. Thankfully, it got thrown out of court, but it’s still extremely stressful.

I know horses are considered ‘property’ in court so there is an implied ‘warranty’ but you have all the videos and info from when you sold, so I doubt she has any leg to stand on.
Its a very hard sell to come back to the party so late, if she had in the first month then maybe she had a case.
Different scenario entirely, but I have been threatened by a lawyer that I was going to be sued over ‘X’ when asked to supply discovery of apparent evidence, that went quiet and was never mentioned again.

And of course im in a different country, but my experience is that a judge will take a dim view to be asked to award against vetting and training fees that were used, when purchaser didnt attempt to contact you and make you aware of issues.

You never can be sure how these will go, but I suspect she has buckleys chance.
