Help with APHA papers transfer ownership

Ok my sister in law didn’t get a bill of sale when she bought my mare 6 or 7 years ago (they gave her to me 2 years ago) but I believe they bought her with cash and don’t have any kind of proof of ownership to send to the APHA to transfer the ownership into her name so it can be transferred into my name.

I do have proof of ownership but it was signed by my sister in laws husband as they both owned the horse at the time and it didn’t matter who signed it, but will that cause issues with the transfer ownership on my end if she is in my sister in laws name or is there something that can be done to help this issue?

Or do we need bills of sale at all? I can’t seem to find any information on if they are needed or not.

I think the reason you are not getting much response is the only one who can truly answer your question is the registry. They should have a way to ask these types of questions.

Granted, my girl’s APHA papers were issued 19 years ago, but the listed owner had to sign the back of the registration papers at the time of a sale, and write in the new owner’s info. Once mailed in, new registration papers were issued in the new owner’s name.

Did the owner listed on your mare’s papers sign the transfer line? If not, you may have to go back to that original person.

Talk to your Registry. Level with them. You may need to talk with their legal dept. I had a somewhat similar issue with the Arabian Registry. Horse sold twice no transfer papers. Original owner dead. Horse abandoned on my Mom’s ranch - with other horses. I had to go to court for an order. I could have done it myself but LITS. The legal dept. told me exactly what I had to do. You don’t mention why you now want her papers. After six or seven years - perhaps you don’t need them?

Almost every registry requires the owner of record, the one named on the registration certificate, signature on a transfer form. Far as the registry knows, they still own the horse. Registry has to be told it sold and to whom, they can’t track anything if they aren’t told. JC is an exception, they don’t track ownership unless it’s racing or breeding.

Do you physically have the papers? If you do, call the registry and they might be able to help you trace that last owner but after 7 years, might be tough but the registry might be able to help you.

If you don’t physically have the papers, just going by what your sister was told and then told you it could be the end of the story and waste of time to try to persue it.

So, do you have the original papers in your possession or not???

In a previous thread I think you found your mares actual registration papers on line, she was a Paint with distinctive markings?

I think you need to find the current person attached to those papers and have them sign them over.

OP don’t hesitate to search for the owners who need to sign off. I do a lot of research on-line, and honestly, it’s rare I can’t find someone. [found my uncle had two wives and two lives!] When I bought my horse at an auction, I wanted to trace him back to his breeder. I started with the action house, who gave me the Coggins Test --that had the person who sent him to the auction on it but was unreadable- --by doing searches with the horse’s registered name, I found the horse had been to two actions, back to back, before I bought him --I bought him at an action in MI, but he’d been purchase by them at an auction in NY -kept for a month --then put up for auction again. From the Coggins paper I had the vet’s number who did the Coggins teste – I called the vet and they gave me the name of the person who had the Coggins Test done (it’s not private info if I bought the horse, duh). I found her on facebook, she told me she’d been given the horse by a friend, I found HIM on facebook, and he (very chatty fellow) told me all about the horse (he’d had him for 6 of his 11 years). He then gave me the name of the breeder (and that was on horse’s papers too) and said he’d been a neighbor and they had given him the horse when they moved from NY to AZ. I sent the breeder a long letter -she replied --and I have all the details of my horse from the moment he was bred until I bought him at auction --the only unanswered question that I don’t know how to ask . . . why did anyone part with this fantastic horse? He’s a delight. I ride him almost every day (not today -20 out) do my trap line with him, fox hunt with him, and do mounted archery with him. He clips, bathes, loads, stands for the farrier and is easily trained to do new things. I suspect breeder had too many or bred him to sell him (but she rode him herself for 4-5 years), then off to the chatty man who had him another 6 and did win some money roping/sorting with him, then to the girl (seems like she got married and had a baby in the year she had him), and then to the auction-auction —and to me.

Did you follow up with the poster who offered to give you the last registered owners name and current address on your previous thread? You have to start with that certified letter to the last know owner of record as that poster outlined when they shared the steps to restore lost papers in APHA.

Alrighty I will clear some things up, first off I did not buy my mare let’s just say 6 and a half years ago, my sister in law bought her 6 and a half years ago and she gave her to me 2 years ago.

Second my SIL never transferred ownership on the papers because I don’t think she knew how or what to do or if she didn’t have the time, I just don’t know why she never got around to it.

Third my mares papers are at my SIL brothers house because her brother bought the half sister of my mare from the same owner at the same time, and the horses were staying at her brothers house because our pasture was being redone, my SIL also was in the process of moving.

​​​​​​My SIL never got around to getting the papers for me as I already had proof of ownership I wasn’t in any rush, and she was extremely busy with work. But now my SIL and her brothers family are having a legal battle over my BILs company to put it shortly, SILs brothers son whom was a partner of the business was embessling huge amounts of money.

My husband is going with my SIL over to her Brothers house with law enforcement to help get the rest of SILs belongings from the brothers property and my mares registration papers. the other post I had made about a new certificate was before I found out about him getting the original one.

I do know who the current owner on the registration papers is and I do know what I would need to do if I needed to get a duplicate certificate.

I was just asking when transferring ownership if I had to send a bill of sale with the paperwork. Because my SIL doesn’t have a bill of sale. And it might jarr the process of getting the papers up to date.
