Yes it is. He can be served by sending the complaint and summons to his last known address and publishing notice of the suit against him in the local paper every week for a month (SC statutes may differ). If he does not reply, the the Plaintiffs will get a Default Judgment against him.

Once a Judgment is recorded it will appear against his name and any other aliases he has used (and which are named in the suit). Anyone who is doubtful about doing business with him, and who searches anyone of those names will find it and be warned.

Plus if he persists on libeling people on the Internet, a Judgment can be used as proof that a court has ruled against him in a suit brought by a lot of people. Yes, he can point out that it was only a Default Judgment – but the question remains – “Why didn’t he defend himself if he was innocent?”

I don’t know how many parties it takes to qualify as a class action suit in SC. But a young attorney may take this case under a contingency fee, not because it will earn him the big bucks, but because it is something to put on his resume.

Or all of you can file suit separately in small claims court. You can’t get blood out of a stone, so financial recovery is not the end goal. Warning other people is.

Hopefully one of you has a relative who is an attorney and who can walk that person through the steps so that the suit is successful in small claims court. Then he/she can share that knowledge so all of you can follow suit (as it were :lol: ).

I am not sure how small claims does it (and I have never practiced in SC at all) but in higher courts in states I have practiced in, similar suits with identical fact situations and identical prayers for relief against the same Defendant are often consolidated in the interests of expediency. If so, you will have achieved your goal of a “class action” but still be in small claims court.

This last suggestion is off the top of my head and it may well not be feasible in SC, but might be worth looking into.

Just some thoughts to consider.

The reason why people can get away with doing to unsuspecting buyers what has been alleged here on this thread, is because the victims do not get together, hire a good lawyer lawyer, and take action.

Find a good trial lawyer. One who likes to try cases. One who has handled class action suits before. One who has a thriving practice so that he can carry the case through to completion without nickeling and diming the plaintiffs.

Too bad old John Edwards is under indictment. He is a great trial lawyer. And with his girlfriend being a horsewoman, he’d be able to get up to speed on the horse business.

Although i havent personally dealt with him I was extremly interested in the horses he was selling. Im so glad i stumbled upon this thread when it was first started. I cant believe he continues to post new ads but now he doesnt leave a phone number. On the ad it says to email first and than follow up with a phone call. Its so hard not to know which ads he posts. They are always cheap warmbloods being lunged over jumps

I know the text isn’t written in typical Thompson style, but the chunky braids and some of the pictures remind me of him, plus, this ad is in SC.

Good research Pinkpony! I guess he’s moved to Connecticut now? LOL! The link you gave is for a horse located in CT? We should call the contact number and see if it’s him. We can ask her about the horse, and see if we can dig-up some new dirt. Here are some more ads on equine that I think are him. We have got to stop him! He’s out of control! Not every horse for sale in SC is Thompson Moore. Aiken has, oh, a few horse owners. Unless I see free-jumping over the blue barrels …
