I started referring to LK as a “gunshot victim” simply because the Barisone apologists stated that she wasn’t a crime victim, because there was no crime. They were correct on that point - no crime was committed since Barisone was found NGRI.
She was shot by a gun, and nearly killed, so “gunshot victim” seems pretty darn obvious and technically accurate, and doesn’t run afoul of inaccurately referring to a crime. That’s why I refer to her as a gunshot victim rather than as just “a victim”.
If we want to tie this to the civil trial, I disagree with your argument that LK caused and is responsible for her own shooting because she caused MBs insanity. Your post is by far the most eloquent version of victim blaming I’ve seen. The victim being blamed in this case is a gunshot victim, not a crime victim.
RC is one of the defendants. It seems likely that LK would not have been shot if the gun were not ready to hand (of a mentally unstable person). This tragedy does speak to the dangers snd horrors of the US gun culture. But in your (generally uncompensated) narrative, it’s LK, not the person who shot her or the person who illegally provided the gun who is responsible.
Correct me if I’m wrong, but it would be entirely up to the judge as to whether or not they grant a motion to dismiss part or all of the claims and counterclaims… correct?
Is there an appeal process that could play out with respect to a judge’s ruling on motions to dismiss? Or… would appeals wait until the entire case had gone through an actual trial, subsequent to any and all rulings on motions to dismiss some or all of the claims and counterclaims?
If say, only one party gets a summary judgement in their favor, say SGF in this case, and then the entire case is later dismissed without prejudice, if the plaintiff chooses to refile the case at a later date, does that then open SGF up again to another suit? Or does the original judgment absolve them from being included again?
Also, if say this case gets dismissed without prejudice, can it even get relitigated again at a later date or is there a statute of limitations that would restrict the timeframe this could happen in?
I thought @Virginia_Horse_Mom was asking whether a judge’s ruling denying a motion to dismiss could be appealed after the whole trial had been completed.
The summary could begin: “The good news is we have completed the review of the documents. The bad news is we have completed the review of the documents.”
