But the point of that line was not that there is video surveillance, there is no video surveillance, but the case law says we don’t have to disclose this stuff prior to a deposition.

It just seems so weird that he has gone from a history of providing not citations at all, just saying - this is so because I say so - to randomly providing a whole bunch of citations on a totally different topic and pretending they apply to the topic at hand.
She rode and competed when she went back to NC and when she first arrived in FL, before the trial, she posted training pictures and such. After the trial, it was probably a different matter, because she wants to show she’s “broken” for the civil suit.
Now LK et al. are reassured that Attorney Silver doesn’t have any “surveillance” videos.
I believe that the videos that are out there of her riding are social media videos posted by her or someone on her behalf.
I do not follow her anywhere but from what was discussed here that is how I understood it.
Didn’t she post about how far she has come, how her riding has improved a ton?
But no one has alleged that there are any. GAS hasn’t asked for any.
That line was solely about how improper GAS’s request for documents prior to deposition is. Not about what the specific documents are.
I have seen multiple posts by her that state this.
It’s also very weird that Mr Silver provided enough proof of where he found the information (LexisNexis) that GAS could easily have Ronald or someone else pull the same report. LexisNexis is a common tool in a law firm. And that right there is part of Mr Silver’s point, which isn’t about privilege at all.
@omare, I don’t know if it helps your situation at all, but I noticed that @ekat has put all of the files that are discussed in this thread in their first post of the thread. They did not start this thread so that post is a scroll from the top, but it is still very handy to have all of the documents in one place for easy reading.
It feels like GAS and Ronald have spent more time giving the courts pages of not related citations than it would have for them to simply go look up this document on LexisNexis.
Were those posts before the verdict at the criminal trial? Has she changed her tune since then, as someone mentioned above?
All over YT, specifically the videos of the trial, she’s bragged about living her best life, improved riding, riding at a higher level than ever months after the trial.
The only relatively recent video I remember was one where I think it was actually a lesson of somebody else at that barn, and she just happened to be riding around in the background.
But I also don’t follow her on social media, so maybe there are other videos that she put up herself.

It seems to me like that would make it harder to claim that your life has been so irreparably damaged that you should get awarded huge damages in your civil suit. But I am certainly no legal expert.
