I would think that the bigger crime was subbing in Kenneland for Belmont. Thats a HUGE crime in my eyes!!!

If I were them I’d be more inclined to sue because they mentioned Chick’s name and then totally ruined his call. His call was WAY more exciting. The movie basically just had him tolling off the lengths. He’s 6 ahead. Now by 11. 26 lengths, etc. They left out my favorite part, where you could hear the wonderment in Chick’s voice as he said “Secretariat is all alone!” And the reassurance he gave a little before the end when he said “Secretariat is going to be the Triple Crown winner!” At that point I still was afraid somebody was going to come charging up and pass him, the way so often happens.[/QUOTE]
I agree! And I will say that while we were filming the Belmont (yes, at Keeneland) they DID use his call while we pretended to watch the race. I couldn’t believe when I finally saw the movie that they played that horrible music down the homestretch.

The entire movie was a crime:(
I used to do this kind of work for the studios – legal clearances, news/stock/archival footage, etc.
The contracts in these situations are quite solid. Anderson also would have had a contract with CBS, which would cover their rights to license his calls.
The heirs are making a nuisance suit in the hopes that Disney will settle. Most studios will settle, for token amounts, because it’s cheaper and it basically buys off the nuisance folk. But Disney’s legal department can be quite pugnacious, and I don’t see this suit having much merit given the contracts involved.
I’ll park this news here as tweeted by the DRF’s David Grening July 19, 2012
Hall of Fame trainer Frank “Pancho” Martin died Wed night. He was 86. Services Friday 10 am, St Thomas the Apostle. West Hempstead, NY
Sadly folks of today only knew of him by how Disney’s Secretariat film portrayed him and that wasn’t positive. Jockey Ron Turcotte took issue with the film on that:
Turcotte also had a problem with the way trainer Frank “Pancho” Martin was portrayed. Martin trained Secretariat’s rival, Sham. In the movie, Martin can across as a loudmouth, obnoxious lout. It came across in press conferences that involved the two camps.
Turcotte said it wasn’t that way.
“Pancho is a wonderful person, always was,” Turcotte said. “I loved him, he was great to me and it hurt me to see the way he was portrayed.”
May he rest in peace.
