SafeSport question

I was just reading an article elsewhere about how the Safesport suspension list for equestrian very nearly doubled in size in just the first month of the year.

That got me to wondering. What is the difference between:

  • Criminal Disposition – Sexual Misconduct
  • Criminal Disposition – involving a minor

They are apparently separate causes for suspension - one trainer mentioned in the article was suspended for only the first charge, while another trainer was suspended for both charges.

So if the first one doesn’t involve a minor, what kind of sexual misconduct would it entail? Sexual assault and/or rape of an adult? Or is there something else I’m not thinking of?

(And no, I have no personal stake in this issue - I’m just curious.)

I have no idea. But criminal disposition means I think that the person was charged and convicted. Safe sport doesn’t need to do an investigation and is required to act on the notification person has criminal conviction.

So what kinds of things count as sexual misconduct? The laws on this vary a lot from state to state. You could Google a bit.

Also now that so much is online you could find old charges for such things and Safe sport would need to act on them.

Thanks! I am not sure though that it necessarily means “criminal conviction.” Perhaps something more like “criminal investigation”?

In the one case that involved a minor, criminal charges were filed - the article mentioned that the accused was “arrested on multiple felony charges.”

But in the other case (not involving a minor), the article did not mention actual criminal charges. I’m thinking that perhaps the accuser elected to not press charges - although if that were the case, I would think that SS would drop the suspension. Or am I misunderstanding the process?

I love how SafeSport is going after sexual predators / sexual abusers in sport - it is long overdue - but I find some of SS processes and guidelines a bit confusing. I do admit though that I haven’t spent a lot of time studying the SafeSport literature since I am not showing.

What does criminal disposition mean to Safe sport?

I’m sure you could find out on their website whether it applies to charges or only conviction. I think it applies to charges for temporary suspension but then conviction for a permanent ban, but have not looked into it

As far as what sexual misconduct means, that is going to vary by state and country. All SS would be interested in would be if there were charges or convictions somewhere.

I happened across the article in question and wasn’t sure about the differences in SafeSport’s definitions for Criminal Disposition – Sexual Misconduct and Criminal Disposition – involving a minor. I’m not sure I am curious enough though to go digging through the SS website, so it will probably remain a mystery to me. :smile:

The information is on the SS site. I have seen it but didn’t set it to memory. If gone from the sport means gone, don’t care why.
