Two questions:

Where was it being stablished that the breast implant was damaged when LK was shot? Was this one of the doctor’s testimony?

And where has it been established that LK has quit riding due to physical therapy on scar tissue? I suspect his one is unsubstantiated.

She stated at one point that her implant saved her life then there have been multiple discussions as to whether that was possible and deflection if one of the bullets off the implant to break the window instead of a third shot breaking the window.

Dressage takes core strength. Her core was perforated and sliced. Her lung collapsed. They went in under her arm to reach the aorta to clamp it when she was bleeding out. They slit her open from stem to stern so her organs could have room to swell and not stop her breathing.

Anyone who has had a C section, mastectomy, radiation, or other core penetrating surgeries or injuries can attest to discomfort afterwards, sometimes something that can be worked through and sometimes debilitating.

With this post you’re confirming that by finding him NGRI, the jury did conclude that, beyond a reasonable doubt, Michael Barisone shot LK.

Not even a little bit since I wasn’t in the jury room. I can’t confirm what they concluded.

Maybe they figured LK had bullet holes, NGRI is a safe answer because there sure was overwhelming evidence as to his state of mind.

Maybe this was a compromise because anyone in my camp (NG) didn’t want to spend a 5 day weekend thinking about but not talking about the case, and again, NGRI was a safe answer.

Maybe to those 12 jurors, shoddy police work is so standard they don’t expect forensic evidence, so bullet holes was good enough.

I cannot confirm. I wasn’t there.

By saying you would have hung the jury by holding out for a straight NG because you don’t think the prosecution made its case that he shot her, that implies to me that the unhung jury that unanimously agreed on NGRI was in unanimous agreement that the prosecution did make its case.

Re bolded: according to the jury instructions, they’re not even supposed to consider the issue of insanity until after they’ve decided that the prosecution made its case that he shot her.

Not a legal expert here, but if the bolded were true, wouldn’t the verdict have been GUILTY?

The prosecution had to determine he did the act but since he was deemed insane and unable to have a criminal intent he is Not Guilty by Reason of Insanity (NGRI). Had the prosecutor not proven he performed the act beyond a reasonable doubt, he would be Not Guilty (NG) as they found for the charges concerning RG.

Verbal contracts are still contracts that can be enforced.

Seems to me it would be very difficult for a “verbal contract” to be enforced if the involved parties disagreed about the substance of said contract, particularly when one party is a highly successful and respected individual in his chosen profession and has a stellar reputation in the community (not a nuisance or a problem, no arrest record, etc.). And the other party is a lifelong grifter and self-admitted drug addict with an arrest record, and has admitted in court to lying whenever it suited her.

That is one of many reasons I believe the NGRI was the right verdict. He had the upper hand. Her escalating behavior was all helping him to have her evicted under New Jersey’s emergency eviction clause for disorderly. None of this needed to happen, a great tragedy.

Can you tell us one more time about how they slit her open? I don’t think that anyone knows about that.

We have no idea what kind of physical issues LK has experienced following the shooting, slicing open, etc. We can only guess what she “might” experience or what others have experienced. You don’t know that she stopped due to physical issues.

Seems to me, the plan was to force him to evict her so she could sue him for broken contracts. Why else would she be talking about subpoenas, perjury and moles in the barn before the shooting…

It is funny you ask that….there is evidence that MB kept really good records of things like training agreements. LK has never admitted to written contracts…but has previously talked about (and subsequently deleted) who was involved in negotiating with MB for the renovations and has made quite a bit of commentary about enforcing contracts…

The document in the middle of the angst was an annual release from liability standard form used by many barns. That and the “get rid of her” comments I believe to be all innocent but once she was shot twice, it is understandable that they are perceived in a more sinister light.

No one said it was a direct quote. But you continue to portray the idea that MB did not negotiate with his own lawyer, LK and JK for a week, possible two, to have LK moved to a facility 15 minutes down the road with a suitable trainer, and that LK refused. How is this indicative of her being in any way malleable? Her behavior showed no indication that she would honor the eviction and quietly leave. “Finish the Bastard.” You keep asserting that a buy-out was the appropriate route and I completely disagree.

LK/RG posed as a risk not only to MB but to everyone and everything on the farm. LK has gone above and beyond to prove that - barefoot ninja, illegal recordings, late night disturbances, threats on SM, discussions about handguns, a violent past, the list goes on.

Per testimony from MHG, MB also provided many alarming quotes. The sad irony is the threat was MB, not LK. Even RC missed that.

Walking takes core strength too. She can walk, so riding isn’t impossible. Plus she stated afterward that she was riding and I recall a video where she happened to be in the frame for a few seconds (after Aug 2019).

I still cannot believe that you are satisfied with the police work and think that they did their job and did it well. Even if I saw this in another case or all named were redacted, I would still not be satisfied with the police work. I think we are just so far apart on this, and that’s fine, it’s your opinion and all that, but to me it’s a low standard.

Yeah, that’s what I recall too. Idk that a bullet can ricochet off her silicone implant and then lodge itself somewhere (so, some force still behind the bullet). I am not ballistics or even physics expert though.

Well, it sure feels like Groundhog’s Day around here. It’s boring, and I’m not sure it’s serving anyone… but I guess it is fodder for entertainment in a grotesque, trainwreck sort of way.

Because I have way too much time on my hands, I did a little down and dirty analysis of this thread. Before people arrived to rehash old narratives and to decry supposed “bullying”, “stalking”, “sadistic behavior”, etc., this thread was indeed quite sleepy. The arrival of a very small number of posters is what resurrected the thread activity.

I’d think if someone would like for topics not to be discussed, they’d be wiser to not join in the conversation as that only fuels the fire and bumps the thread and leads the topic back to the territory that some claim not to want the thread to go. Never ending cycle… the more posts, the more re-hashing, the more exponential the growth. “Day 21” was the last 24 hours as of post 1118. Done nerding out… but it’s “interesting”.

You are mistaken. That small number of posters arrived after the thread took a mean turn. Maybe if the comments stayed about the trials and not about attacking people, it could stay strictly about the trial.
