Foot dragging, yes that is exactly what is happening
Sidebar, if it may please the court. What is the purpose of those types of spins in reining? I mean, cow horses donât really ever need to spin like whirling dervishes when working cattle - do they?
Lauren Shay Kanarek is the embodiment of a living, walking nightmare client and sheâs so PROUD of herself for it too!
I believe itâs more of a tactical move, in case of a plastic bag may happen along the cow path.
You get an awful lot wrong, donât you. This is how I insurance companies roll. Itâs what the Ks were banking on. Itâs how it works.
Heck, even Arabians donât spin like tops when a plastic bag appears!
LK was suing MB, SGF and RC, not the insurance company. She had legitimate claims against the people they insured.
Yes, I predicted the insurance companies would settled with LK rather than go to court.
Iâm predicting the insurance companies will not settle with MB due to reputational considerations.
Wow seems like you have the Crystal Ball working some serious O/T.
Thatâs cool for you I guess.
I am just a horse of course
Reining horse spins and sliding stops are an off shoot from the original cattle part, no purpose. Itâs not unlike the reason for pirouettes or piaffe or passage in dressage.
CurrentlyHorseless:I meant a pattern of behavior that leads other insured parties to expect them to settle whenever theyâre sued.
UmmmâŚâŚdidnât you argue that this was the exact reason why LK sued and could expect to get a settlement? Because the insurance companies âpay outâ rather than fight?
Your sounding a lot like LK on this particular backstroke.
Itâs not the same circumstances. In these circumstances, I think the incentives are for the insurance company not to settle.
CurrentlyHorseless:didnât mean precedent in the sense of a legal precedent.
I meant a pattern of behavior that leads other insured parties to expect them to settle whenever theyâre sued. Itâs important for them to create a reputation that they will defend their denials of coverage rather than settle. Settling would encourage other lawsuits.

Well, I was correct in predicting the insurance company would settle in LKs suit. What was your prediction?
Itâs premature to say Iâm wrong in this suit. I think they wonât settle.
DownYonder:Good job, Mr. D. I certainly hope those insurance companies realize it will be cheaper for them in the long run to settle with MB rather than to continue their denial of responsibility.
It is not cheaper for the insurance companies to settle. If they settle Barisoneâs case, theyâll be setting a precedent that theyâll roll over and pay out when anyone else sues them for not providing defense. Itâs worth it to them to spend millions to avoid setting a bad precedent.
MB was delusional on the issue of whether he was in physical danger from LK. Thatâs different from being delusional as to whether shooting her would be expected to cause injury.
They will settle and pay.
I was surprised that they were still using the the same old blame the victim with the insurance companies. That tactic may work for a criminal jury or injury civil trial but it has no bearing that I can come up with on this one. This one really hangs on intent and per Google searches, an NGRI verdict is not a pass in federal court.
And you received your law degree and trial experience from where? Ever work in a court? Watch a number of civil trials? Read the decisions? Anything?
LilRanger: CurrentlyHorseless:If they settle Barisoneâs case, theyâll be setting a precedent that theyâll roll over and pay out when anyone else sues them for not providing defense.
Settling actually helps them not create precedent.
Their obligation to pay in such a situation would only become precedent if the insurance company loses on appeal.. If they settle it has no bearing on any subsequent case.I didnât mean precedent in the sense of a legal precedent.

Itâs an issue of reputation, not legal precedence.
Your unfamiliarity with law is showing. These cases go on all over the country numerous times a day. This case wouldnât be setting anything.
Hey, even a broken clock is right twice a day!
What was your prediction?
My prediction was that MB would not be convicted guilty. Yours?
Itâs premature to say Iâm wrong in this suit. I think they wonât settle.
And Laurenâs prediction on her SM was that Michael would be in Greystone for years and years. I guess thatâs not coming true, either.
Yeah thatâs what happens when legal amateurs pretend to know stuff.
Courts tend to be so individual in their practice.
No, the LK/JK prediction was Barisone wpild be found guilty of "double-tap murder " and spend the next 30 - 40 years in prison. Thatâs why she immediately filed her law suits, never thinking she would be in a position to have to prove his guilt in a civil trial. Grifters and shysters.
