He is adamant his (MB) statements can not be used to use any argument to the jury. Only admissible to his state of mind.
Taylor wants this trial to be based on Barisone’s state of mind. That’s what all the testimoney has been about.
Well atleast COTH did come up with some pertinent questions. The judge is addressing some of the most burning COTH questions here.
Exactly! And now he can’t have the self-defense charge. His defense needs to take the lesser charge of attempted assault NOW. Or he might get sent away for 40 yrs!
I’m at the point that I want to reach through my computer and flick the judge in the forehead…I apologize in advance if my comment is out of line.
He immediately left, drove to the farm while armed. There was a confrontation, RG spoke to MB and then LK came out.
Even if the jury doesn’t believe JK or RG they would be engaging in speculation to determine if the beating happened after the gun was withdrawn
He says its pure speculation and there is no evidence on the record.
Taylor states that there is no evidence on the record about order of events. Sounds like Bilinkis can NOT propose that the beating was first, and the shooting second.
The concoction of a “bright and creative” mind.
Im so glad we are able to listen in!

Because I can’t post what I am really thinking.
taylor’s right, they never proved or introduced the idea that the beating happeend first. Sadly.
But they can not prove that the beating was not first, so why can’t he say that?
In my case this is why the alternates were kept in a separate room and not talk about the case. That way if one of us was unable to finish deliberations one of them could step in without being tainted.
I’m having a hard time understanding why. Something about the CPS worker not being crossed? But that sounds so odd.
It makes little sense that they don’t. EXCEPT that MB wants a full exoneration. Not the safest move.
Yes fascinating stuff
The quote function isn’t working for me but I completely agree with what @caffeinated posted:
“I just don’t know that it’s enough. Without MB’s memory/account, what facts we do have at least roughly line up with the victims’ account. Right now my feeling is that he will be found guilty, but this whole thing is a whirling vortex of human tragedy – for all involved. While I have some really negative feelings about LK and RG… I think their lives are probably not easy and think they have a lot of demons to grapple with constantly. Not to mention being shot, and the aftermath of it, that’s some serious nightmare and PTSD material I wish on no one. I wonder what someone’s life is like, that the things she did leading up to the shooting seemed like a good idea or worth doing. It can’t be a good place to be in.
MB… well… to be so high, but so fragile, and to break in this way… it’s just tragic and immensely sad.
Them meeting, and their different brands of crazy playing off each other - it was just the perfect storm, in the worst possible way.”
My impression as a rather impartial observer is that two people with significant psychological issues ended up in major conflict. The person who escalated to gun violence is on trial for those actions (as described in @Rowdy’s post).
I also feel the jury will likely see it the same way, but that’s to be determined.
Can I say in advance that it would be nice if posters could refrain from snarky remarks if someone shares a view they don’t like? Such as telling others to ignore them. There is room for many opinions, and seeing some other posters share thoughts I agreed with made me feel more confident about sharing my own.
But they can not prove that the beating was not first, so why can’t he say that?
All the evidence presented says otherwise and there is insufficient evidence to even suggest that.
Self defense charge will not be given. He says self defense is contrary to the defense expert Dr S
Paraphrase
Mr Barisone, wrt the charges, do you understand…
MB “Whatever Mr Bikini is says”
Taylor explains more
MB “yes, he’s informed me, and whatever Mr Bilinkis says is what I go with”
Talk about trust and faith.
Taylor has a point that actual self defense would be contradictory to Dr. Simring’s key testimony
