Basically it goes: There is NO evidence that the beating was first. They can not enter that in because there is simply no evidence to suggest that and defense has not brought any in to support it.

On a slight tangent, I am having a lot of fun imagining the prosecution’s summation.
“Yes, the victims are terrible people who methodically set out to ruin the defendant’s life, business and personal relationships, who broke the law repeatedly in their attempts to drive the defendant to the brink. But that doesn’t mean they should have been shot!”
A little more seriously, the prosecution is going to have to acknowledge that they were awful people who were tormenting MB or risk losing the jury all together. But I wonder how far he can go acknowledging that and still make a case.
If aggravated assault charge is brought but found not guilty by reason of insanity, couldnt MB still be in the position of being in a mental health facility indefinitely?

And everyone needs to remember, Bilinkas has a history with Taylor with a high profile murder case, where Bilinkas won a new trial for his client on appeal, and then the client ended up with a reduced sentence.

It’s not that uncommon in trials, I watched an episode of a series recently where the guy was a serial cheater and serial domestic abuser but didn’t kill his wife. They said in closing arguments just what an absolute POS the man was but that didn’t mean he killed his wife (evidence didn’t support it and it was someone else).
I think as long as he’s a danger to society. Which… I can understand. It’s up to the treating mental health professionals

Well if the “sentence” is going to be essentially the same regardless of charges, might as well hope the jury sees the defects in the State’s case.
Based on the fact that the timeline wrt whether the beating preceded the shooting relies just on the two LK and RG…
Based on the aggressive actions of these two he’s confronting to work this out (and Grecian Formula even Saud that’s what MB said when he got there), the gun was necessary as self defense even at a simple face to face contact… Bilinkis us fighting for this self-defense claim. I do believe its appropriate and gas sufficient evidence.
That’s what I recollect.
Sooooo… I wouldn’t be surprised, IF MB is found guilty, that this goes to appeal, and then it ends up as something lesser, and a 10 year sentence.

Judge is saying that the jury has to speculate on various alternatives for self-defense… But isn’t that where doubt comes in due to the insufficient evidence in the record wrt what came first, the beating or the shooting?
Judge states Self defense was a delusion.
But a delusion to MB is real.
