This probably would require a ruling, but i would think sounds heard in the background of a call are not subject to privilege. The privileged communication is the words spoken between client and attorney.

If I’m an attorney and I believe my client is in the act of committing a crime, that’s definitely not privileged.

Also, the client can testify to whatever they want. It’s the attorney who cannot reveal the communication, but the client holds the benefit and if they say what was said, well, that’s their choice.

No, he doesn’t hold a job. It was said that he gets day laborer work when needed, but otherwise just hangs around with LK all the time.

He does all the shopping, driving, laundry, house cleaning, tacking and untacking all the horses, cooling them out, etc.

Notice he DIDN’T SAY MB OWED HIM $50,000!!!

Highlights of Robert Goodwin direct examination 2:20 - 2:35 pm:

RG’s observations of MB’s personality. Bold, loud, alpha male. Not RG’s type of sense of humor (some racist/sexist jokes). When asked about deterioration of relationship part of RG’s reply was “Michael drove the truck down and tried to murder us.”

RG owns no guns. LK has/had one that she keeps/kept in NC house.

RG had drug problem through adult life. Would use anything he could. Sober for maybe 7 years but has relapsed a few times. Did not use any illegal drugs on farm.

In 2018 MHG and MB lived in upstairs barn apt. Summer 2019 they moved into the house.

RG never threatened MB.

Cameras were motion-activated Blink cameras with free storage. RG installed them inside and outside the house and was familiar with how they worked. Day of shooting there was one camera in the house in the hallway and he was doing laundry and kept getting notifications walking back and forth. He turned the cameras off to stop the notifications.

During week before shooting, police were on property on a daily basis. Missed a little here about whether RG had spoken with police himself.

At some point did you become aware MB wanted you to leave the property? He was making life difficult at the farm, for us to stay. Is there a reason you didn’t just leave? Hopes for salvaged relationship.

RG was in barn wrapping leg when Cassandra started dryer and and he heard her telling RC to keep an eye on laundry because the dryer was not shutting off. He was sick of everything going on and worried about fire hazard. RG drove to town to deliver complaint to township on 8/5/19.

Didn’t JH say he was living in a temporary situation in the barn? sleeping in a storage room sounds about right for what some working student housing is like…

FM came next day with a team to check place out

2pm, folding laundry. (They have a lot of laundry)
On phone with atty David, to work out situation with MB, what to do about pay arrangement wrt horses
Met with David at some point

Yeah, I don’t know his status re actually being in the military or not completing training (could be many reasons for that). I’ve been around a fair amount of US military members and they’re not all eloquent, respectful, and proper in the ways they conduct themselves in various settings. Plus if RG served like 4 years many years ago, for example, he’s been out and away from the culture for awhile, and it doesn’t always stick. Sure this is a formal setting, but not a military one. Some members carry that over and naturally conduct themselves in such a way as they were trained, some don’t. Especially if they’re no longer in the military.

My long winded and perhaps poorly articulated point is that RG’s current behavior, postures, and the way he speaks aren’t a good way to judge whether or not he had a short stint in the USMC.

Sort of a tangent, but just my thoughts on the matter.

Presumably since these are the witnesses he’s calling, he’s drafted an outline of what points he wants to cover in what order and he knows what the answers will be.

He doesn’t have to respond, like he has to in redirect and for cross examination, and what I’ve seen, his redirect has been less silky smooth, which is not to say bad, but that’s been more on-the-fly as it has to be.
