Yes, this is basic. There is a “furthering the cause” exception in the sense that if the third party is for example a member of the lawyer’s staff, or an investigator retained by the lawyer, or something like that, that person’s presence does not violate privilege.
He may have thought that would apply if RG was the “other tenant” but he’s not this attorney’s client.

I seem to recall during LK testimony that there were text messages about checking with “the lawyer” or the lawyer saying that the recordings were ok. Either they never did check, or this guy just lied on the stand since he said there was never any discussion about recording “to his recollection”.
All this “I don’t recall” seems so… fake. You know you’re going to be testifying. I can’t believe all these people didn’t bother to review notes prior to showing up to testify in this kind of case.

Doesn’t it seem very odd that RG was given a transcript of that tape recorded conversation with the lawyer in preparation for this trial, but the lawyer himself was not? And the lawyer said just now he has never even seen a transcript of it??

I don’t really expect that a lawyer would text with a client of 1 or 2 days who is asking whether she can record people. I guess it could happen but it would just be…unusual.
I believe she tried to hedge that in by saying “the lawyer” could have been her dad.

that may be part of what this 104 hearing is about, since that transcript was already used for another witness.
As an aside, this 104 has been going on for a not-insignificant amount of time.

I kind of wonder about the jury waiting in the jury room right now. They might not be allowed to discuss the case yet, but I’ll bet they could be shooting some hairy eyeballs back and forth between them.

I’m pretty sure it was texts with her father, which makes it odd that she’d refer to her own dad as “the lawyer” in texts directly to him. Or maybe it was RG she was texting, but doesn’t make it any less weird.
So Ed is stating LK said, “it’s Barisone, he has a gun.”
Is it confirmed RG was upstairs and went downstairs to hand LK phone? Wondering if RG were upstairs if this is why he missed crucial information before LK states MB has a gun?

They’re almost certainly being attended by an officer or bailiff while removed from the court room.
That’s for their own safety as well as to preserve the fairness of the trial. It’s as much to make sure they are not approached by witnesses, media, passersby, or anyone else as it is to keep them from talking to each other, but they are certainly not unsupervised.

I have to say, that as someone who used to represent parents and kids in ANE cases, I am having flashbacks! Ugh. MB was smart to not plea, as much as the judge may hate this shtshow, it was the right move.
