It still seems odd to me that this lawyer on the stand now seemed to be caught off guard by the whole subject.

The lawyer said he spoke to LK for “some time” before that utterance so I don’t think that makes sense. It makes more sense that she was upstairs or went upstairs, because the attorney did not mention any voices in the background or any mention of Barisone besides that.

Can Ed testify to what was communicated between him and LK prior to the statement that MB has a gun?

Probably not, as the conversation was between her and him in regard to the subject landlord tenant dispute (presumably) but others in the background or background noise he may have heard is not germaine to that conversation and not privileged.

If they chatted about an upcoming beach vacation, that’s not privileged either.

Maybe it’s just me but if I saw a guy with a gun I wouldn’t be having a conversation about it. I’d be running.

Yes. But he said they didn’t discuss recordings. There is definitely an audio recording about recordings….And RG was definitely there…He already testified to it.

Is anyone else thinking that this attorney- David - would be wise to consider his own reputation right now. These people were involved in a NASTY landlord tenant dispute, clearly doing unethical/illegal things with respect to recording devices… and they went and testified under oath that he in fact advised them regarding their recordings, and what was legal or not.

If I were him, I might want to get it on the record in some way shape or form that I did NOT advise or endorse any of their recording activities. If that was the reality of the situation.

For the record, it’s my opinion that neither this attorney nor the police ever actually told them that the recording they were doing was legal. I think LK and RG have twisted really basic conversations about one party consent laws into some weird justification for their illegal activities. And I suspect LK thought attorney client privilege would keep that particular bunch of nonsense from being discovered.

So this lawyer has been practicing for 40 years. Not a young guy with a career to worry about. How much is he getting paid by by JK to lie on the stand? His recount matches does not seem to match up with LK or RG particularly closely?

result of 104 is that “the evidence” is not admissible. Not clear what that evidence was but it appeared to be related to the recording of that meeting.

The incredible coincidence that this lawyer calls Rob’s phone in the SAME MINUTE that MB is allegedly blasting up the driveway on his way there is too strange for words, but I suppose stranger things have happened.

I’m not alleging a conspiracy. I’m alleging an incredibly convenient coincidence, like that’s beyond coincidental.
