Wasn’t SW of Dressage Hub banned or censured in some way by USEF - despite not being a member?

If so, then can’t they preemptively keep RG away from show grounds where USEF/FEI/SafeSport rules apply?

And the rest of the country will shake their collective heads at the predicament of yet another ridiculous ā€œFlorida manā€¦ā€ (Or ā€œFlorida womanā€ as the case may be.) Of course, the irony will be that they are not really ā€œFlorida manā€ or ā€œFlorida woman.ā€

Most of you don’t want to hear this.
But, the question in a civil case brought by LK will be, was she injured and, if so, who is responsible.
A verdict of NGI means that a criminal case found Barisone shot her, almost causing her death and resulting in permanent damage that impacts her life. A judge could rule that whatever led to that shooting is moot, it has been es tablished that it occurred.
Are the farm owners liable? There will have to be evidence of knowledge that there were illegal guns and access to them.
The property owners have a good damages case against Barisone: as the tenant he allowed the guns to be there. He did not keep the property maintained by not properly repairing the water damage in a timely ma tter.
Barisone cannot claim damages related to bring charged with crimes. Those were made in good faith by a public officer and proved not frivolous (the NGI finding). He can claim emotional dis tress, depending on his ongoing evaluation, either temporary or permanent. That’s the only place where LK’s actions have relevance.
These offsetting claims seem like they will lead to some negotiated set tlement.

I do think we all need to temper our expectations regarding MB’s release from civil confinement. All appearances during the trial show a man who is quite broken. 21 months in county jail during a pandemic certainly did not help his mental status any and the court is going to need to be assured that he is not a danger to others or probably more substantially himself.

The best he may get in 30 days is being allowed to being placed in a private facility, rather than a state run facility. Which certainly will be an improvement.

But I’d love to be wrong and have him get conditional release or a step down program…

What bothers me is that despite all the evidence about LK’s demonic campaign to terrorize MB and ā€œdestroy himā€ - and in which she was enabled by her family - that same family would be intent on continuing that campaign. I think someone used the term ā€œcockroachesā€ in another context, but perhaps it applies here…

But I have a question. I’ve never posted to any of her SM accounts. My screen name here is not the same as any of my other SM screen names. How would she know that I’m in the ant-LK group? (Although I don’t believe the few things I’ve posted here were offensive).

Is there a way that someone can match my IP under my screen name here with my IP under my other SM accounts? If so, that is really creepy that someone would take the time to do that.

Until people start looking at contributory/comparative negligence, and the components of LK’s ā€œIntentional Infliction of Emotional Distress.ā€

And let’s not discount MB’s counter claims against him. Another jury just might see that she intentionally inflicted emotional distress on him.

Sure, it could happen exactly as you say. But MB has already requested a jury trial, and we just saw how well the key witnesses did in front of a jury.

Personally I think it would be in everybody’s best interest if all the claims were just dropped. But I don’t see a world in which MB is going to agree to anything that involves a settlement.

As a citizen, I will respect the laws of my own country as well as those of foreign countries in which I or my horse(s) may compete. Knowing that as a USEF competitor and/ or horse owner I also serve as an Ambassador for my sport, USEF, and my country. I will endeavor at all times to reflect credit on them through my conduct, dress, and behavior.
I clearly acknowledge my responsibility to ensure that my employees who accompany me whenever I am competing and/or representing my country also abide by this Code of Conduct.
I understand and accept that serious or repeated transgressions of these Codes may be grounds for suspension from a squad or team, or other appropriate disciplinary action. In addition, I agree to abide by selection procedures established by USEF wherever applicable

USEF needs to do better for us all

I am worried about the Anne Kline Center. I am comforted by MB’s size and @OneBellBoot ā€˜s post about the medical professionals that work in places like that, but I also worry that ā€œsomeoneā€ with influence in the state could get to the powers that be and say, ā€œWe need this guy to spend 5 years here. Make sure your monthly reports support thatā€!

what an excellent jury, I worked for 2 criminal lawyers in Texas for 22 years, and I never once had an insanity case. Courts ditched that option after John Hinkley Jr was granted insanity and sent to a fancy private mental hospital instead of prison for the rest of his life. He now lives in an exclusive area last time I checked where a golf course is on the premises and guess who uses it? former presidents LOL, So dude is lucky, I hope he gets the help he needs.

First- I thought that MB owned the property in NJ? Perhaps I am wrong.

However, regarding the civil case filed against MB, as I have mentioned before, she needs to show the damages that were caused by this incident. Can she ride as well as she could? What handicaps does she have, etc. She also needs to be someone that a jury can sympathize with. That isn’t going to happen. Can she prove that she was shot? Sure.

Then you have the fact that she intentionally destroyed MB’s ability to do business, and inflicted such emotional pain upon him that he snapped. Everything that was proven in the criminal trial is going to be shown again in the civil trial.

If you are a juror, how would you feel about her trying to get paid for causing someone so much emotional distress that he did snap, and shot her. I do not think that is a financial winner.
