He has no real tie to the horse world except a girlfriend who likes JBs foals so why are y’all entertaining him? There’s tons of bored people who watch cat videos on Youtube or Jerry Springer on TV or insult each other endlessly on political website comment boards cuz they’re bored. That’s why he’s here. I’m surprised JB is privately emailing people telling them to make retractions here and on other boards. What are people saying back to her? Doesn’t seem like there’s anything real to retract since people are relaying experiences and talking about real pictures. Is the lawyer sending the emails legit? Is she suing her SIL for posting public pics?

Who has Romantic Star…how sad I love him and considered using him.

Truly I hope she gets some help. She has been given opportunities and horses that I would die to have and I am working hard to produce. I can’t imagine just throwing that all down the drain.

Well, yea, anyone can sue. You’re right. but frivolous lawsuits are often frowned upon in court and lawyers know they probably won’t get paid. Then there’s the countersuit for lawyer fees for the frivolous lawsuit. My point was that JB doesn’t seem to have extra cash laying around so I can’t see that hiring an internet attorney to go after lots of members of a bulletin board for speaking ill of her business is any kind of real option. It’s not like she’s going to get damages to pay for the suit. I posted that when people were talking about internet lawyers and threats of suing people for speaking ill of JBs practices on a bb.

Frivolous lawsuits are Jill Burnell’s specialty though. Did you read about her current lawsuit where she bought a mare for $500 then the mare owner found out what sort of person she was and changed her mind about the sale before the mare shipped? Jill Burnell has a current lawsuit against her asking for $10,000.

I did hear about that. How on earth did she justify the added expense? Did she add the value of unborn foals from that mare? How did this end up? From what I remember that was an oral agreement with nothing in writing, no signatures, etc.

The time arrived to have our scheduled court date and although I brought a bank check made out to her and offered it to her, she refused, saying she would only take over 5 times the amount she had paid me. Of course, I was not going to agree to this. The judge dismissed the case in the county she filed in because it was the wrong county – neither of us even lived within its boundary. I understand now why she did not file in Sonoma County, for fear of being served with judgments she has out for her there. She has threatened to serve me in the county I reside in and I welcome it. I have a herd of people behind me, ready to stand up against her.

For those of you who keep wondering why someone with outstanding warrants against them is not in jail, perhaps you might not know, the State of California’s prisions are in serious crisis due to budget constraints. There are many current articles you can read to understand the situation better. To summarize it; the less violent criminals are getting to pass go so their places can be filled with those criminals that pose the most threat to society. Others whom are less violent are being filtered down to the local county jails. The state prisions and the county jails are over-crowded. It’s basically a scary mess much like the entity whom is the topic of this thread.

Lets quit blaming the victims of Jill Burnel – who has history of defaulting on obligations – right there in the public records for all to see.

As one of Jill Burnell’s “victims”, in that I had a long, upsetting, but ultimately successful battle to obtain a Redwine filly’s GOV papers and finally received them by obtaining help from GOV and none at all from Jill Burnell, I think the tone of this particular thread has become silly. Equally ridiculous is the idea of converting any supporters of Jill Burnell. Only a fool or someone naive would enter into business with her and I can tell readers of this thread from my own experience that the leading breeders, trainers, and owners in the United States and Canada already know that she is engaged in fraud. It’s been discussed ad nauseum in my presence at the major warmblood breed conventions this year and among members of our national committees, many of whom are owed money by her.

The idea of a group action is commendable. Many of the postings on this thread are not.

On a better note, there are hundreds of stallion stations and breeding operations here, in Canada, and elsewhere in the world owned and run by very knowledgeable and reputable folk with whom it’s a pleasure to do business. There is a delicious gene pool of much better and more talented stallions than any of those that Gray Fox Farm “stands” and where collection is done in a clean environment, shipping is done on time, and where there is helpful backup if the breeding doesn’t take. Why are we hammering on with this discussion?

It’s obvious that Jill Burnell is disfunctional and has engaged in crime. It’s obvious that with large sums of money coming in and going out in such a way that the I. R. S. should be very interested. This is an elegant set-up for money laundering, whether or not that is actually happening, as the Gray Fox Farm office management/bookkeeping system is a total mess, perfectly represented by the fact that horses’ paperwork can’t be produced when needed, nor can the owner in fact. It is certainly to be hoped that honest people don’t engage in business with Gray Fox Farm. Enough has been testified against her to warn them off if even a little research is done.

Don’t know the law so I’m just throwing this out there but can they seize the horses as assets? Wouldn’t that be something if she lost her horses b/c of all the money owed? Maybe then they could go to legitimate breeders!!

Exactly! Unfortunately I have been involved in three lawsuits all of which were horse related. I won all three and did not collect a single penny for any of them. In my case it was worth it anyway because the racing commission will ban anyone with a judgement against them that is unsettled so at least I got them off the race track. One of the lawsuits was against a woman I had known for years who free leased one of my favorite horses of all time from me for her kids. About a year in she sold him to buy crack…

I am not an attorney (this is not legal advice! – speak with an attorney) but yes, I believe there are procedures through the court which the holder of the judgment can peruse a foreclosure on assets.

A judgment (like what the feed store, vet and attorneys have in Sonoma County) is a judicial lien.

A judgment is a “floating lien.” The creditor needs to get this floating judgment lien to “attach” to specific property of the judgment debtor. Once the judgment lien attaches …The creditor can foreclose on the judgment lien property. Accordingly, the judgment creditor needs to find the debtor’s assets, and then get the aide of the court to make the judgment lien attach to that asset and then foreclose on that asset…

First, the judgment creditor must obtain a “Writ of Execution” or “Writ of Fiera Facias.” The Writ of Execution is an order from the court to the sheriff to satisfy the judgment from any personal property of the debtor in the sheriff’s county…

In order to attach the judgment lien to personal property, the judgment creditor must know the identity and location of the personal property.

If someone is in the area - you might want to run it by the local Sheriff that she may be removing fencing, etc. from the property. Under normal foreclosure circumstances - the property owner is allowed a limited time to remove “personal property”. Improvements such as fencing, sheds, etc. are normally considered to be part of the value of the property - which is now in the hands of the lender.

App. 1999). A reader further points out that, even when the burden is technically on the plaintiff to prove falsity, the plaintiff can easily shift the burden to the defendant simply by testifying that the statements at issue are false.”

Please keep in mind I have not read this thread. I was not making allegations that anyone was defamed by suggesting the link.

It is always our goal at Rate My Horse PRO to encourage others to educate themselves so they don’t become a victim or make the same mistakes others have.

Our team, including Debbie Hanson, offers a variety of victim services for those needing some guidance.

So the real lesson here, as far as I can tell, should not be to keep your mouth shut, but rather to document, document, document. If you have a complete record, you should be able to meet the burden of proof.

And it sounds like a large number of people here have enough documentation and witnesses to cover those bases as it pertains to Jill Burnell either owing money, needing to deliver registration papers and/or breeding certificates, operating a lab in unsanitary conditions, overcrowding and undersheltering livestock, and leaving a pile of dead foals lying around the farm.

So I don’t think Jill Burnell has much of a chance at winning a defamation suit with all the evidence piling up, unless someone goes completely crayola fantasy fiction crazy when talking about her.
