ORDER

This matter is before the Court on the Petition on Supervised Release and on the government’s motion to modify the conditions of supervised release. Base on the record in this matter, including the Presentence Report, the proffers made by counsel during the hearing held on January 6, 2006, the letters presented as evidence by the government, and the letters presented as evidence by the defendant, the Court GRANTS the government’s motion to modify the conditions of supervised release. The Court finds that the following additional condition of supervised release is necessary to protect the public, and further finds that a partial prohibition would not provide adequate protecton. Accordingly, the Court MODIFIES the Judgement in a Criminal Case dated June 24, 2004 by adding this additional condition of supervised release:

The defendant is prohibited from any employment - self-employment or employment through a legitimate employer - in the equestrian/horse industry. This includes but is not limited to the buying and selling of horses, the breeding of horses, acting as an agent during the sale of horses, acting as a horse trainer, or acting as an instructor for riding lessons to any individual.

It is so ORDERED.

Let the Clerk send a copy of this Order to all counsel of record and U.S. Probation.

HOGWASH! Maybe the VHSA didn’t know about their fraud felony concerning the sale of horses when they mailed in their dues. I know the board knows about them NOW!!!..the DOJ (that is the FEDERAL Department of Justice… FYI) and the Probation Officer have contacted the VHSA regarding the Judge’s comments. Read again…

So do you have any idea how many others these two turned into victims of their crimes? I’ve met the little girls that lost thier ponies to these theives. I’ve spoken to the people who were scammed out of thousands because these two were able gain their trust.

These two faced more indictments than the Enron Execs who will spend their lives in jail! Keg and Josh plead guilty to ONE of the 70+ charges. Is this the character of persons the VHSA relies on for membership…Heaven Help US!

Every private association does have the right

But that right is the ability to accept criminals into membership or to reject having criminals in their association. I would think that anyone who deals horses with a criminal could expect to wind up like Helen Brach if they become unhappy. :yes:

I would like to voice my support for this and other related proposals to prevent those who have been convicted of felonies related to horses and the horse business from acquiring or retaining their membership in this federation. Upholding the principles of fair play and humane treatment for the horses we are privileged to ride and show should be the first priority of the federation, and to allow those who have been convicted of such crimes is inappropriate and detrimental to that effort.
