Federal Fraud Case

JB…somewhere in my files I have a lovely photo of Montana, I’ll have to see if I can find it. I think Diana sent it to me way back when. He was gorgeous!

Aw, that made me smile, Debbie. He was quite the looker and always turned heads at the horse shows! But even more endearing than his looks was his charming personality and gentle manner. Once I lost Montana, there was no one else in the barn I felt comfortable riding while pregnant. Diana came through for me again, however, shortly after I “foaled” and sent me another gentle giant by Aristos B and out of one of her Sir Thompson mares. She’s my angel in many ways.
Debbie, have you received your check? Do you think that Josh and Keg understand that so much of what they took can’t ever be repaid? :(

JackieBlue, I would love to see a pic of Montana should you ever want to post one here. He must have been very handsome.

Diana is such a wonderful woman! No, I have not yet received a check but did receive a letter in the mail from the DOJ saying it was forthcoming. I’ll let folks know when I do.

No, I do not think they understand or even care. I think this excerpt from a 20 page brief written by the US Attorney in 2006 pretty much sums it up (the brief is public record).

“Second, the prohibition on employment in the equestrian industry was
reasonably necessary to protect the public. Cardine engaged in a long term, extensive fraud scheme in the equestrian industry. In carrying out the scheme, Cardine stole horses from their owners and sold them without the owners’ knowledge. In other cases, in full breach of the horse owners’ trust, Cardine sold their horses at the request but reported the sales price as substantially lower than the actual sales price so that he could fraudulently keep more of the sales proceeds. Cardine also seriously
abused and mistreated horses, causing severe injury or death to the animals. Finally, Cardine endangered young children riders by selling horses he knew were not only not suitable but exceptionally dangerous to the young riders, falsely assuring the parents that the horses were sufficiently gentle for young riders. The children also
suffered psychological impact in the disillusionment resulting from learning their trainer was a thief. In addition, the district court had the benefit of the opinions of a large number of persons engaged in the industry concerning the appropriateness of Cardine’s continuing in the industry, who stated in strong terms that Cardine should be prohibited form horse-related employment. Thus, the record amply established that Cardine should not continue in the equestrian industry.”

This should be engraved on a brass plaque and posted at every major show office across the country. Well heck, maybe it should be paraphrased and tattooed across Josh’s forehead! Everything that Josh did was reprehensible and low, but the fact that he prayed upon children and their parents…unforgivable! And the fact that there are pony people who have friended him on Facebook? Incomprehensible!:eek:

JB - what an awful story. I am so sorry for your loss. May I ask what happened to the woman who let her dogs chase your horse? Did she take any responsibility?

I haven’t read through most of this thread, but JB it warmed my heart to hear Somerset came to you like that in a time of need

Oh, Veronica, he will always have a most special place in my heart! Not only was he my “go to guy” after extended bed rest and a horrific delivery when my daughter was born, but he was there for me when I returned to riding after having my femur broken during a “routine” knee surgery. It was a compound fracture, just above the knee that resulted in a nonunion lasting a whole year before I was well enough to undergo a revision surgery and finally healed. He took care of me like I was made of glass and never got irritated with my stiff and useless left leg and totally lacking balance. And as if that’s not enough, my daughter and I, when she was very small, would climb on him together and go for loooong, leisurely walks around our property and The Barracks and he never, ever missed a step, even when the hot air balloons from The Boars Head would come down right over our heads! He’s a very, very special boy, indeed.
For those who don’t know Veronica’s amazing horse, Somerset, he has 2 outstanding hunter sires in his pedigree - Aristos B and Sir Thompson - he’s fancy as all get out, he’s an absolute saint AND he won on the line consistently as a youngster (Upperville, Devon, Warrenton, etc…). Talk about the complete package! <3
The picture is of Somerset (ahem, perhaps a little pudgy at the time) and my daughter, Erin, and is very indicative of the loving relationship they had.

And now he packs me. There is nothing but pure good in that horse :)

I bought a horse from Diana a few years ago. She is indeed a wonderful person. I think “plump” and “bombproof” run in her lineage! My mare looks pregnant and does not get any grain. I recently took her to Morven Park for a lesson (she had never been there before) and when I was walking towards the indoor I heard a noise behind me. Skipper and I turn our heads to see what it was… it was a haflinger pulling a cart full of kids. My heart stopped beating but Skipper could not have cared less!

Sorry for all you have been through, but glad Diana carried you under her angelic wings!

If you would like to read the full brief you can find it here. It just went up and is marked as NEW.

Rate My Horse PRO has also reopened the petition to USEF for NO Reinstatement for Josh and Keg if you would like to sign.

Debbie asked me to let you know that documents in the above case will be going up in the coming months.

nice one – thanks

Once again, WHY make excuses for these people? JC has a normal old FB page and those pictured on it have “friended” him in the usual manner. Even if he had a business page, who in their right mind would “like it”? And don’t think for a minute that his FB friends don’t know his history. NOBODY missed Josh and Keg’s downfall. Apparently many just weren’t/aren’t bothered by it. And just as many are jumping to their defense. :sigh: I love this sport.
I know… I just wanted to let people know that, because I didn’t. There are a few people I don’t like, who have “liked” something of mine on FB… so people may see that and think that we are friends or something. We aren’t. I’d rather put sandpaper under my eyelids for a day than deal with them. It would be less painful. But alas, I can’t do anything about it.

SGray,
I will provide you with the information I have regarding the case. It is public record. Unfortunately, the case was rendered 3 months before the Federal Court in Trenton went electronic.

Many THANKS to Rate MY Pro for their hard work to begin this service and their dedication for education of the consumers in this industry.

Guess what??? Just got a call from Channel 8 in Richmond…they are airing this story TONIGHT at 6:00!!! It will also air on Friday but tonight will be a longer version!!!

Tune in everyone and let me know how it is!!! Please post if you watch it!!
Do you have a copy of this you can send me?

Never mind, RNB… I just found it.
But on another note, what was the date of the USEF hearing? Just got a chuckle thinking it might have been today. If that is the case, I’m hoping for the same outcome for another scumbag!

The Jill Burnell thread is discussing how to prevent someone from owning horses after a conviction … Caveat:.she is not charged and IF she is … is presumed innocent until proven guilty in a court of law.
Anyone care to share how that worked with Josh & Keg??

I am not familiar with CA law, but I imagine to prevent someone from owning horses it would have to be part of a conviction.

In Josh & Keg’s case, the Federal court system (The late Honorable Richard Williams presiding) ruled they could not own, sell, buy, etc. horses during their 3 year probation after being released from prison. They were also ordered to pay restitution to the victims listed in the court documents. Any horses they owned prior to and during the trial were to be seized and sold to pay off said restitution. Only one was seized. Others associated with them were registered, or transferred into other people/family names before trial.

Another giant loophole in the system.

To answer another question from above…full restitution was paid to all the victims in 2012. This was made possible after Keg inherited a farm and a Federal lien was placed upon it. It went in to foreclosure approximately 6 months later. IIRC.

Looks like Josh is back to his old ways…
