Sounds awfully suspicious if the buyers were “short” with the seller after all this time of her bending over backward to grant their every wish. You can be sure they will come up with something pretty sleazy.

In a situation like this, I would ask the buyer to do the ppe BEFORE the horse left on trial. Especially shipping one so far. If they’re seriously interested in purchasing the horse and would need a satisfactory ppe before doing so, it’s a no brainer. If the horse doesn’t pass the ppe then there’s no reason to send him out on trial. That way, the only reason the sale wouldn’t go through is if the horse and rider didn’t work out together and it would be written into the contract that the horse would have to be returned in the same condition as it left. In other words, “you break it, you own it”. Plus, they’d have to insure the horse. I’ve been put in the situation where they wanted to trailer to a vet a few hours away for the ppe and they were required to insure and the written contract also stipulated that if the horse was injured in any way during the transit to and from they would be required to pay full purchase price.

Let’s play ‘Guess the next move’
My guess is that the ppe will not have gone perfectly. The horse was a little ‘off’ and vet recommends another ppe in the next 2 weeks. Re-evaluate then. Meanwhile, kid gets to ride in another show. And it will give them enough time to come up with another excuse to keep the horse until the winter circuit is over.

Well if it doesn’t work out (and I hope it does work out) and Thing 1 and Thing 2 try to screw buyer (and I hope they don’t) there’s this website called www.horseshowspy.com. There’s a section called “Under the Bus” where it’s perfectly ok to name names. And a “Trainers and Judges” forum too. So if buyer and trainer don’t want adverse publicity, they need to do the right thing.

Friday is the 18th. It’ll be a busy day if the buyers are having the horse vetted and paying for him :wink:

The 18th is the last day of this most recent trial extension, right? Epona, I think you should advise your friend to set up something with a FL COTH’er to go get the beastie on Friday if things don’t work out. She needs to have a contingency plan in place now! If they decide they don’t want him, or she doesn’t want to accept their offer, I just bet they will charge her board until he’s picked up :yes:

And, at the risk of repeating myself (Risk? No risk! A certainty!), the seller should insist on a wire transfer to her account before 2 pm on Friday, January 18, 2008 or the horse will be picked up immediately by the seller’s agent (a willing COTHer, I hope!).

Once the seller has the money in her account (wire transfer ONLY), she can elect to leave the horse with them longer if she chooses. Of course, the next thing will be that the radiographs need to be developed, etc. As if a lameness referral vet in Florida doesn’t have digital radiography!

Gosh, I am flying down to FL Friday afternoon & won’t be back on COTH until the 22nd. I can just tell I am going to miss a lot of good stuff! :lol:

Well, bloodwork won’t be back instantly, you know, and I bet a second opinion or extra time to interpret the x rays is on tap…and MONDAY IS A BANK HOLIDAY.

Yep. :yes: 'Tis what friend should do immediately. Or, even better, get friend to find someone who will carry out my plan, just to show up with truck and trailer and bill of sale, and just take horse out of there. If they want him, they can come vet him wherever he is. And friend can choose whether or not to tell them that. Unless, of course, she gets what she’s been promised by Thing 1 & Thing 2 (love that! :lol: ) all this time. :winkgrin:

Findeight is correct. The owner needs to send the following email to perspective buyers:

Please note that I had graciously given an extension for the horse to stay on trial and be vetted so long as it was completed by January 15, 2008. Subsequent to that, you requested an extension so that the horse could be vetted and paid for on January 18, 2008. In the interim, you have used my horse, trailered him to shows, and shown him. Please note that I will not permit another extension nor do I want to hear that you need to wait for results of bloodwork or the like given you have had my horse for well over 45 days. I will not accept that the vet had an emergency or anything of the sort so perhaps you should have a contingency plan in place in the event your specialist has some undetermined conflict. The money for the horse MUST be in my account on January 18, 2008 no later than 1:50pm by wire transfer and here is the wire information. If the money is not in the account, I have made arrangements to have the shipper or myself pick up the horse January 19, 2008 in the morning and you will need to have X dollars for the shipping in cash as agreed upon when the horse was taken on trial.

Please note that regardless of the outcome of the vetting, I am NOT reducing the price of the horse so let’s make sure we are real clear on that point to."

Just have to chime in again:
This is probably the most dramatic yet oh so informative thread I have read yet. The saga is riveting but I know I have made about 50 mental notes of things to do and not do when buying/selling a horse! I’ve been around for a long time and I know there are comments and suggestions all through here that I still had just been making assumptions about! Wow. Glad to have the resource yet again!

Biggest lesson: assume NOTHING and get EVERYTHING in writing!!!

Can we just imagine for a minute the coming sales season with all of this running through our collective heads? Folks are going to have a tuff time getting any deal even remotely similar to this from how many thousands of horse people…what is the head count on views this week?

How many of us do you think will be told that we are being unreasonable. Not that it matters if you give a pft about what will happen to the animal…good riddance right?

Hopefully your friend is scared enough about the situation now, to finally get some balls on her, and not take the low-ball offer.

And really - if they just wanted it to “all be over” - couldn’t they just gasp PAY FOR THE HORSE. :lol:

Of course, once the horse is paid for (either by the people currently with the horse, or someone else), this drama will continue when we get bombarded with guilty (or not guilty? ;)) parties telling us how mean we are for looking at/posting pictures, bad mouthing things 1 and 2, and not having full confidence that they were going to send money.

Or, better yet, buyers back out on sale because us meanie-heads on CoTH said such awful things. :eek:
