MB CIVIL SUIT UPDATE #10 K’s Request to Adjourn (delay) DENIED 11/01/22

MBs current SS suspension is not a sanction. He is on an interim suspension while they investigate and determine what the final disposition of the case will be.

The interim suspension will be lifted when SS completes its investigation.

I am not advocating that MB be permanently banned, and would have zero influence on SS anyway.

Question for the legal eagles - and apologies if this has already been asked.

Do judges hearing civil cases in these types of situations ever review the circumstances surrounding the associated criminal trial?

Is it possible that Sceusi might take a look at the L&C coverage of the criminal trial and/or the evidence or transcript of the criminal proceedings? Or is that verboten?

Remember the reality show “America’s Next Dressage Star” or something similar? Dover was the master and JJ Tate, Rebecca Vick and Brendan Curtis were the only three contestants I can remember.

There was a similar show for Big Eq, Brianne Goutal was on it, maybe? The Maddens were on it, and Norman Della Joia(sp)?

Omg. I LOVED that show. I believe it was called Road to the Maclay.

I saw them filming at a bunch of shows, and I knew how it turned out in the end, but it was still fascinating and hilarious to watch the whole thing play out.

When they showed the individual episodes on TV each week that winter, it was always a hot topic of conversation the next day at the horse show. Lol.

I think the episodes are posted on YouTube. Or they were a while ago, anyway.

Nancy Jaffer wrote an article in May when the interim suspension was done. It said: “The not guilty verdict puts a new wrinkle in the SafeSport proceedings. Since opening its doors in 2017, the Center has not dealt with a similar type matter, according to spokesman Dan Hill.”
SS has to determine whether the NGRI is exculpatory like an NG verdict or if it is not, like an Alford plea. This is a matter of law separate from the particulars of Barisone’s individual case. Because Congress did not write that specifically in the law, the SS legal staff has to extrapolate what their intention VS. an NGRI would have been.
Then that finding would be applied to Barisone. If NGRI is exculpatory, that removes the criminal charge misconduct on him. If it is not, the criminal misconduct has been verified by trial.
SS can consider that and other evidence then in a decision. Barisone has the right to appeal directly to SS. His attorneys could also challenge the NGRI interpretation to a legal court.

What happened isn’t even remotely close to an Alford plea. MB never pled guilty.

It was adjudicated plainly. Not Guilty. No crime, no mens rea. There is no extrapolating it any other way in my opinion and logically speaking.

I suspect once the evidence of all the plotting since April 2019 comes out, SS will have a hard time justifying any kind of suspension. I’d bet that the interview is a formality that has to be completed before a decision can be released by SS.

None of the factors of consideration lend to any kind of suspension. Maybe a few mental health clearances will be required over the next couple of years, but nothing that would significantly impact his participation in the sport.

Yes, I’m a nobody in a bunch of nobody’s posting on COTH forums. Of course, JK did say on 48 Hours that MB should be in a prison (not an institution) for the rest of his life so I’m wrong there. However, IM said he could see a scenario where LK took lessons from MB again.
