Alex Steiner was awesome for me! He connected me with my first dressage instructor (a student of his) and gave me some good advice on dealing with my first WB who was having some difficulties due to abuse prior to me getting her. He was super nice. Even called a couple of months later to check up on our progress!
Claim = Plaintiff suing defendant(s)
CounterClaim = defendant saying no, plaintiff owes me
Cross Claim - defendant one saying I’m not liable, Defendant two is (or defendant 3) basically, defendants (or, alternatively plaintiffs in cases where there are more than one) making claims against each other, even though they are all defendants against the plaintiff.

@ekat, what are your thoughts on this filing? Is it a typical, expected response or were there any bombshells? I read it but must admit I did not understand all the legal stuff.

My favorite part was where Deininger asked LK to list all the damages she was claiming, with a response time of 5 days.

So, MB, through his attorney filed to amend his counter claim against LK, and add the count of the harassment by illegal recordings.
LK, through her attorney Nagel, responded with, nope, too late, Statute of Limitations is up.
This is Mr Deininger explaining why Statute of Limitations does not apply in this instance. Because MB had no way of knowing for certain that LK was actually responsible for hidden, surreptitious, illegal recordings until she admitted it under oath in the criminal trial.
So, seems to pretty much be what we have already talked about here.

Recently wasn’t there back and forth on this thread about when and how Michael knew about the recordings? Who began that line of discussion and why? Perhaps I missed it but did Nagle say Michael was fully aware of the devices? In other words did someone have inside info prior to this filing?
Yes, as I said, Axel mellowed after he and Terri married. He’s always been a good judge even with lower level classes when asked to judge them. He has always been generous and kind to his scribes as well.
As we all know, everyone can have a bad day and take their emotions out on others, it happens, and I didn’t continue to hold it against him.

Yikes! As much as we enjoy reading them it is good to remember that they are very expensive for the client.

That was a great diversion! I’ve come to the conclusion that most horse people (even the very famous) are generous and kind to other horse people. Of course you do have the bad apples too, but for the most part.
