No, I just went through traffic lights and bicycles to see there are no new updates.
My parents would disown me.
That’s fair, but why overrule the mental health professionals who evaluated MB?
To be clear I don’t see a conspiracy. I see an over worked, under funded mental health system and perhaps a judge with some bias.
But your parents raised you to not behave like this person. It is important to remember the Kanareks are an anomaly to the accepted social and ethical norms of a civilized society IMO.
So true. Think of all the “fans” notorious serial killers have had.
Hrmph….
Dear Mr. Silver,
We know you are reading along. Make up a pro bono filing just so we can read another magnificent work of art today.
Pretty Please and Sincerely,
The Illegal Bathrobe Mob
PS. Include in a foot note if you would like to be sent a complementary bathrobe and tiara.
I think he’s already earned them.
Honestly though, in real life, not a movie or what we want to happen… what do you think the real consequence would be for an offhand crap comment? Because a slight reprimand is pretty much it. Maybe a formal note in the file if it was really bad. Maybe a mandatory ‘training’ session.
I have read some pretty horrific comments that Doctors have made to patients. I have yet to see anything more than a note in the file and in extreme or repeated cases, the mandatory ‘training’ session.
(Ex - the OB who commented to a transferred patient from the midwives who had laboured for 48hrs and needed an emergency C-section stated loudly for all family and nurses to hear “Man, all you ladies just looking for the easy way out with these beauty C-sections, don’t want any damage to your vaginas!” - yeah, he got a talking to and a note in his file. Not saying it’s right, but it is what it is.)
We just had a local case where a senior doctor was finally fired after about 20 years of repeated and continuous reprimands for awful comments to patients (worse than the above). He was even barred from being alone in a room with female patients (he was an OBGYN). I think that is eventually what got him fired, not his comments, the breaking of a different rule.

Doctors, Judges, Lawyers, Cops, Presidents… there are a few positions of power that lead people to face fewer consequences for the garbage that can come out of their mouths.
I guess we need to complain louder.
So true. There are very few people I know where money truly is limitless.
It reminds me of situations where a client has come into some sort of buying situation without ever having the intention of buying. It seems they just want to engage in the experience of it and waste time. I never understood that.
CurrentlyHorseless said she gave credit to Ekat for being a lawyer and then poof, it’s gone.
Half Halt for crying out loud - HALF HALT
I agree. I think it will be a slap on the hand at most for Judge Taylor. I also don’t see any repercussions to MB still being at AK. It’s as if those working within the system know it’s broken and just accept it.
Re: your story about an OB
It reminds me of bed side manner from the 50’s where an OBGYN might be smoking a cigarette during an exam or even had hard liquor on the job that day. How women were spoken to as they were expected to birth children and their roles as house wives - how they would be perceived as failures for not being able to bear children, that type of thing. I think things have gotten a little better in regards to over all bedside manner and patient’s rights but I still think the potential for abuse towards patients is pretty high. It’s pretty scary to think about people in power and the type of person in those roles.
I’m tentative in saying this opinion (because that is all it is) as there are such strong opinions on both sides.
But. In the judge’s mind, if he release MB and he shoots someone else, the mental health professionals whose expert opinions he followed are not the ones blamed. The judge is. It happens often - a judge releases someone on probation/parole following professional recommendation, they commit another crime, people start coming for the judge. (Yes, I understand that is a different situation b/c there someone has been found guilty. Just using it as an analogy).
MB almost killed someone. Yes, some will debate that, and I’m not interested in having that conversation. Yes, he was absolutely mentally tortured leading up to it and by no means am I trying to convey any sympathy at all to LK. There just was a 0% chance any judge was going to let him walk completely free after the verdict. I’m sure his attorneys knew that too, and told him.
My best guess is that the professional opinions were ignored because of the severity of the actions taken, and the transfer hasn’t occurred because of a lack of available beds at the facility he is supposed to be transferred to. Less so a judge imposing his own sentence, and more a judge wanting to CYA. Selfish, absolutely. Not in MB’s best interests, also absolutely. But not necessarily a conspiracy.
It sounds like absolutely there are procedures not being followed in terms of not having another hearing until 6 months out, and ordering a transfer that has just not been carried out. I want to be very clear here that I’m not defending the judge’s actions. But I don’t think any of them scream out bought off/conspiracy with LK/etc. I don’t even think it seems biased against MB specifically, just more a cliche “tough on crime” mentality that you see in a lot of former prosecutors of his age and ilk.
We removed some recent posts that were once again getting focused on personal commentary and addressed it with the poster.
Thank you.
We’ve moved onto the one-rein stop! ahhaa
Legal folks I have yet another question - Before you explained so nicely that there is a filing, and then a rebuttal and then a response to the rebuttal.
Does that apply to the most recent stuff about the email that Jonathan Kanarek sent to the judge?
Can there be anymore filings about that topic?

I think things have gotten a little better in regards to over all bedside manner and patient’s rights but I still think the potential for abuse towards patients is pretty high. It’s pretty scary to think about people in power and the type of person in those roles.
Yup. I worked on a ‘Intervention’ with the Ombudsman’s office with regards to Maternal Health in the system, I read and analyzed hundreds of complaints and the results from the past 10 years. Awful as that was, the good news is that they are actually looking at this data to determine if the responses were appropriate and if improvements are being made. So there’s that.
The back and forth you’re referring to is generally triggered by someone filing a motion (or someone asking the court to do something adverse to the other party). So the first party files, the other party opposes (files their opposition brief), then the first party replies (files their reply brief).
With this third party letter, its not initiated by any of the parties. It came to the court ex parte and then sent to the parties by the judge. So theoretically someone could make some type of motion (like a move for sanctions on the basis that LK’s attorney had the father write the letter), which would start the back and forth of briefing. To be clear, I don’t think they will make a motion like that and don’t think that is true, just gave it as an example. More likely, if anything happens, it would be a letter addressed to chambers, maybe asking the judge to instruct the father to cease all ex parte communications. Such a letter could get a response from the other party (likely agreeing), but not the formal back and forth briefing you’re referring to. I hope others chime in though - its a weird situation so this is a guess and not something I’ve experienced.
