Ah, but I think whether or not he is still delusional is completely relevant. JMHO.
I think the purpose of the Krol hearing is to determine whether the insanity on which the NGRI verdict was based is continuing, as stated in the Nancy Jaffer article.
I never said that “Taylor had the right to make up his own mind willy nilly”.
I said it was Taylor who was responsible for making the judgement call on whether MB would pose a danger to self or others if released. It’s a judgement call. He’s a judge.
He makes that judgement call based on the testimony of expert psychiatrists as to whether the insanity that was the basis of the NGRI verdict is, or isn’t, continuing.
Both defense and state psychiatrists entered assessments indicating that their assessments of his insanity were unchanged relative to their previous assessments: defense psychiatrist said the delusional thinking continued; state psychiatrist said he was not delusional, consistent with their assessment during the trial.
I get that you think my opinion is incorrect. I think my opinion is correct, although different from yours.
I don’t want to get into diagnosing people I’ve never met but, generally, even after being shot, would THAT not give someone pause? Serious question. I just can’t fathom it. I’m no sensitive snowflake (not a political reference) and have done some crazy stuff but I honestly didn’t know there were people out there like this. Of course we all see the stereotypical people with mental illness but it’s not often that we see it wrapped up with a bow. Or is it?
It is closest to Chicago Style in that the sauce is on top and it is a very thick crust. But the crust is sourdough unlike the traditional Chicago pie. They will send them on dry ice if you are up for the challenge.
I’m not diagnosing anyone but I know narcissists so I use that example. Read up on malignant narcissists and their sociopathy. They truly are wired differently from others.
Thank you erinmeri for this information.
I have just finished reading the handbook.
A few things stood out.
POST 1
It looks like MB will have to pay for his “care” here. This is barbaric and probably why Taylor mandated 6 months.
From the handbook:If it is determined that the patient is required to contribute to the cost of care, and if for some reason the patient is unable to meet this obligation, New Jersey law provides the Commissioner with the authority to compromise debts owed for client charges in Hospitals. A compromise may include a reduction, or full forgiveness of the debt depending on circumstances.
I am providing the full paragraph. What the Fruitbat!!!
Do they make people in prison in the US “pay” for their care?
And once again deleting information that doesn’t fit your agenda. Once again as I said in my post that you deliberately cut out, VI.C. Page 32. Actually, if the two psychiatrists said he was no longer a danger to himself or others then there was no longer a requirement for involuntary commitment. Then he does certainly seem to qualify for a Conditional Extension Pending Placement (CEPP). He is then actually released now pending CEPP, when they find and recommend a good place for him to be released to. To be recommitted, he has to be shown again to be a danger to himself or others. I don’t know if the judge violated the 3 months but I also don’t know if the judge released him with a CEPP.
You helped create a tempest in a teapot with your careful deselection of information and now you are trying to continue with my post.
The judge per Bilinkas in the Jaffree article could have approved each step down but allows for that to work through the facility.
Y’all better hope y’all are wrong wrong about the judge being vindictive because a bunch of SM drama loving, neither lawyer nor psychiatrist, complainers could irritate a lesser man than I think the judge is. I think he has shown to be almost unflappable in his dedication to duty.
That is terrible that he might have to pay for that. If that is the case he should be able to select an approved (by the experts not the judge) private care place near his home.
I don’t think that’s for those committed through the criminal justice system. People do have to contribute to their care in public hospitals in the US otherwise. Our healthcare system is abhorrent.
If you’d read the link I provided, you’d see that CEPP is for people who have maxed out of their commitment but have no home to go to. The “Pending Placement” allows them to be held in the hospital until proper housing and placement is found.
Post 2
It looks like he could be allowed home for visits before Christmas if he can move thru the levels quick enough.
Not sure how long he will stay on an admissions unit.
Levels of Supervision
Levels of Supervision (LOS) refer to the Treatment Team’s clinical decision regarding how much supervision a patient needs. Levels range from Level I to Level IV. Unless clinically contraindicated, patients on any level may receive visitors. Active treatment is provided for all patients regardless of their LOS.
• Level of Supervision I: (Maximum Supervision) Patients on LOS I are those who may pose a risk of harm to themselves, others, or property if less supervision was provided;
• Level of Supervision II: (Moderate Supervision) Patients on LOS II have begun to form a therapeutic alliance with staff, have shown signs of progress in self-management, exhibit improved mental status or reduction in symptoms, have improved behavioral controls, and increased level of functioning. Patients are escorted to appointments and programs. Brief home visits are permitted at the Treatment Team’s discretion and if the family/support person is capable and willing to provide direct supervision for the duration of the visit;
• Level of Supervision III: (Limited Supervision) Patients on LOS III generally are able to control dangerous impulses and thus require less supervision than at LOS II. Patients can go to on grounds appointments and programs unescorted. Team approved off- Page 12 of 29 ground trips are permitted with supervision. Brief home visits are permitted after family/support person meets with the Treatment Team and the family/support person is capable and willing to provide supervision for the duration of the visit; and
• Level of Supervision IV: (Minimal Supervision) Patients on LOS IV pose no or minimal risk of harm to self, others, or property and may be discharged upon finalization of aftercare and housing plans. Team approved off-ground trips are permitted.
Oh. My. God. This is so utterly horrifying and disgusting and punitive. Then they “pay” you pennies to make license plates or fight forest fires while incarcerated. What a crock.
